advice on "Driving while prohibited"?
 
I got caught Driving while Prohibted in North Vancouver
last month. I went to many different laywers and all
they say are hire them but they don't gaurantee winning the case
because the police took the picture of me and I hand in my license
to the superintendent of motor vehicle. What they can do for me is
prepare and present for me at the court and set a trial to next year
so I can have an extra year to drive a round.
The average cost of legal fee is approx. $4000ish, and it has to be
paid out from my tight student budget.

Also, the police and towing company noticed me of 30days of
impoundment but the ICBC sent me the letter of 60days. I want to
know if I can get it back on 30th day.

some advice on my situation please?


and never drive while you are prohibited.
this thing is so stressful and cost you a load of $$$ for extra charges
such as towing and storing, DPP, fines and such.

some advice... seriously? enjoy public transportation. i use it everyday to go to work and leave the car at home.

If ICBC says 60 days, it will likely be 60 days unless you are successful in changing that verdict by following the dispute advice on the impound notice.

You have listened to the lawyers, and you also have the option of pleading guilty to get it over with. The choice is yours.

Honestly you should just plead guilty, you know your in the wrong and no matter what you will have to pay all the fees and receive the penalty, whats the point of waiting later on and then receive the penalty... Plus its gonna cost you a extre $4000... If you ask me headaches are things you want to avoid not get deeper into....

BTW: if you plead guilty how long is the suspension for???

1 year of prohibition depending of my driving history record which is clean.

Plead guilty.

Please fix spelling/grammar, I can't really see what you're getting at.

What I would do is just plead guilty and take responsibility. I wouldn't spend 4k on a lawyer that can't guarantee any results. From the sound of it, you're really hooped.

How's your driving history record clean if you are caught driving while prohibited? You had to have done something for you to be prohibited in the first place.

your life isn't over. They have this archaic technology called a Grey hound bus. you should research some archives to see if they still use this technology and see if there is a route to Kelowna. When you get there, use their public transportation system OR use that $4000 for lawyers fee and instead go buy a 50 cc scooter or electric bicycle to get around. scootering around in their 9 month winter is going to suck though.

Total bus fare = $1485.00


Saved by not using a lawyer: 2515.00

a college student's month pass is only $43. thats roughly just over $500 for a full year. so you can actually save $3400 to 3500 but not using a lawyer.

Ah...the 50cc scooter requires a DL...the electric bicycle does not....neither does the non-electric type.

there is no way to have a clean driving record yet get busted for driving while prohibited.

secondly, both schools in Kelowna have pretty good transit access. Plus you can bike the majority of the year unless you're a total wuss. Or you can flip to living closer to campus or living in residence. getting seat sales and flying back to Van for the holidays will be less than the $4000 lawyer fees.

what about those people riding around on a regular bicycle with a small gas engine attached to it?

EDIT: I mean these things -> MAC's, not scooters. so i guess under 50 cc?

this is the exact same situation as mine
i had all the same questions

and the 60 day -> 30 day impoundment thing doesn't apply to you
you'll have to wait the 60 days
only under 3 conditions will they let you do that ... forgot what they were but it definately has nothing to do with you ~

just so you know ... search up my post about my incident
the fine is a lot heavier than you think ... there's points for this too ~ it was just a huge hassle ... definately learned a lesson tho = =

And a heads up on the electric Motor Assisted Cycles - Leave the pedals attached, ensure they're functional and use them, as removing them classifies them as Limited Speed Motorcycles. Once classified as an LSM, they require licencing and insurance, and you need a valid DL to drive them.

If you attach a gas engine to a bicycle it needs to be inspected and pass a VI. It is now a motor vehicle and will require the same equipment as a motorcycle...stop lights, turn signal, reflectors etc.

hahahah i would pay a lot of money to see a cop pull over a bicyle with a motor attached and give him a VI and have it towed... give me a break

I have seen a couple and they took a Honda/ Briggs & Stratton utility motor & bolted it on a bicycle. The "bicycle" now has a speed potential of 70k plus, brakes that cannot possibly stop it in time, no turn signals, brake lights, refelectors, head or tail lights and has very likely overloaded all the mechanical & structural portions far beyond their design and capability. Substitute the word "motorcycle" or "car" and see if it's such a laughing matter? Just think it through...and BTW, when they hit you, there are not insured. Give ME a break.

oh so now all of a sudden there's a problem with other people who use the road not having insurance? what about the cyclists that blow through red lights and stop signs doing 40km/h... they dont have insurance. or the electric bisycles using the roads like they are on a regular motorcycle... i was driving through downtown, with a cop behind me, and two of those electric bicyles in the lane next to me, going as fast as the traffic, with no plates or insurance, but for some reason the cop was more concerned with my front tint than those riding around with no insurance

Electric bicycles are NOT motor vehicles, they are bicycles, and are not required to be insured. The cyclist can be sued in civil court for any damage they cause in a crash. My primary concern was for the safety of the riders who are using a terribly unsafe vehicle. The insurance is only an added problem that they inmpose upon themselves.

I find it difficult to believe than an electric bicycle is capable of main taining 50 plus kmh...by law they are restricted to a maximum of 32 kmh.

Read the paperwork you were given when you were arrested and ordered to show as required. See what it says that requires you to be there at a certain time and date. If you do not appear as you agreed to by siging the release papers, you are in breach of your release conditions. Can you say warrant and criminal charges? Sure you can. :)
