Disputing a ticket - Witnesses
 

When disputing a ticket with a witness, when/how do you give the witnesses statement? Do they have to come to court on your dispute date, and do you tell anyone in advance, or just bring them?

You must both/all attend court. When called you must tell the JP/Judge that you have witnesses and that they will be testifying. They then leave the courtroom. The crown gives evidence first, with any cross examination you want. If you testify then you do next. Your witnesses are excluded from the courtroom untill all your testimony is given and all your cross examination by the Crown is finished. You then call your witness and you ask them questions or to testify under oath on the stand. Crown then will cross examine them if they want.

You may wish to have the court registry issue a subpoena for your witness(es). If you fail to do this and they don't show up at the trial the JP may refuse an adjournment to have them attend.

So, regarding a completely seperate case, seeing as I received a ticket for an accident that I caused, but the only witnesses were direct friends of mine, if I ask them not to show to court then I should be free of my VT?

If they were served a subpoena for the matter they would be subject to arrest and compelled to attend court as a witness.

They currently do not have a subpoena.

You would NOT be free of your VT if your witnesses did not show. The Crown has to have a case against you in order to charge you. They may be able to proceed without your friends appearing to testify for you. They could be subpoenaed by the Crown against you, or the Crown might have enough evidence of it's own to proceed. No show at the court date and you are "deemed to have abandoned the dispute and a conviction is entered".
