The spelling of your last name might be something to argue, but I have heard JP's decide that if the driver's license number and birthdate were correct that was enough to identify you properly and refuse to dismiss because of a misspelling in the name.

And on the other side of coin, a friend of mine once got a ticket dismissed because his name was spelled wrong. His statement to the JP: "This name... is not me."

I could imagine the JP asking "well, was it you that was driving?"

Then he would be SOL, or he could have lied.

The logical answer would be, "Sure, I might have been driving somewhere, sometime, maybe even right there... I might even have been speeding, or not... but I'm not the person named on this ticket."

If a cop handed you a ticket that was for someone else, wouldn't you dispute it?
