Double account? Did she have the silver plate thing that annoy you?

seekerbeta 04-19-2010 12:41 AM

i think it has to do with the bylaw, check with your area for your towns time and dB limit on Noise, 60dB would be a good max for anything after 11pm

and if you live in a condo or apartment, check with the tenant board to see what the rules are for your building, if your within all that, go tell you neighbor to stuff it.

It is illegal under the Criminal Code's mischief section to do anything at any time that prevents someone from enjoying their private property. Loud noise at 12 noon would qualify...

Run the Lawnmower from 7am through till i think 7pm... just idle it there on the lawn... she cant complain about it because its reasonable...

Who/what defines what "amount" of noise would prevent someone from enjoying their property?

There are a lot of unreasonable neighbors out there...

skidmark 04-19-2010 09:57 AM

Crown would have to convince the court that the noise was unreasonable in the circumstances.

//// unreasonable.

Municipal bylaws vary as far as noise goes. Some have a 'curfew" type from 11pm to 7am and here where I live it is a $500 fine. Then the "noise which tends to disturb or annoy" bylaw can be anytime, day or night and it gets you a $100 fine. Works on earbleed car sound systems, loud daytime BBQ's or revving your engine or having your dog bark a lot....as long as it disturbs or annoys.
