No N sign
 
i'll cut the long story short.
I was drinking with a few friends last weekend, i drove to the place, it was outdoor. After we were done, i proceeded to my car, while my passenger had the keys. I just wanted to sleep it off. Cops came by the car, knocked on my window, and proceeded to ask me if i was driving. I told him i wasn't going to be driving, as my passenger had my keys. He then asked me to show him my N sign, i did not have one. BUT the car was never turned on or even remotely on. the keys never touched the ignition. Am i still required by law to display an N sign, if the car is not on?

did he give you a ticket? i dont see how you have to display your n if the car isnt on. what if it gets stolen when youre away?

should not be. car's not moving, you had no intent to drive, and someone else has the keys (who was not present with u). There's not law stating that we have to leve on N signs on when the car's parked and no intent to operate (unless by someone with class 5+). I used to and they always get jacked.

if the ignition is not on, you are not operating the vehicle. dispute it.

Iirc that still puts you in care and control of the car, even if it's off and the keys are nowhere in sight.

ah. that's different. I assumed u were in the passenger seat, and the passenger was gonna drive later.

regardless. You can still dispute. And win. If you plead not guilty, the cop will most likely tell the court there is no evidence.
Even if he argued, it still has no merit.

On top of that: If you were drunk and in the driver's seat, why didn't he charge you with DUI?
ALSO: The cop can't argue that you were drunk in the car with intent to operate if he has no breathalyzer sample. That''s like me telling you that Inaii stabbed someone because I saw her with a knife in her hand, but didn't take any video or pictures.

hey,

a friend of mine dispute a ticket similar to this, however he wasnt drinking.
a cop pulled over another guy already, while my friend went speeding past. so my friend stopped at a bubble tea shop 2 blocks away. the police eventualy came by and gave him a ticket for speeding!!! and fail to display N sign.

so he disputed and won even with the police showing up to court.
He told the judge that the car wasnt even on so why should he get a ticket for not displaying N.

N sign is 4 points off i believe... pain in the ass to have class 7..

This would be like giving a ticket to a 10 year old for waiting in the car while their mom runs into the store to buy something quickly.

No. If they ticket says no N then it's no points. And yes, it is a pain to go through the GLP system. Sure, it 'teaches' the new drives during those 3 years, but man, sometimes I wonder how in the world some people get their Ns it's amazing. I blame it on the exam testers lol.

And to the post above, you wouldn't exactly give your 10 year old kid the keys and leave him alone, would you? If I saw some kid with the keys alone in the car, I would probably freak out lol.

umm... similar thing happened to my friend with his N, he was in his car sleeping with a buddy. keys were turned to ACC though so they could keep the heat on and he got a ticket for a DUI and lost his licence....
