Got kicked out of a store, Legalities???

Hey, I got booted from a Local store. Long story short... I bought a item from there website and isntalled it, the item was defective and they would not take it as a return or exchange. According to there webside its 100% satisfaction and returns on electronics for 14days... no where did it say it was voided after install. The manager said I was a nuisance and if I wasnt happy to send it in 4-6 weeks for repair. I told him off, and yelled at all the customers in the store letting them know there exchange policy. I was escorted out of the store and told never to come back.


So the legalities upon this... am I legally allowed to re-enter the store?? It has been about 4 months since this has happened. There was nothing written to me saying that I was not allowed, just verbally by the manager in charge.

Private property, if they recognize you they absolutely have every right to escort you off.

Although with most retail stores, the staff turnover is so high that they would never recognize you.

You can report it to the BBB, or go to small claims for the value of the product but the store owners/management has the right to refuse or restrict service as they wish.

ya - If they ask you to leave, you are then trespassing on their property.

Did you buy through paypal or a credit card? They will usually help out the customer. Small Claims probably isn't worth your time.

Alright, so it was visions electronics. Now, I tried returning this to the store and I offered to pay the difference for a better product. (it was a $300 alpine deck) They said that after I had installed it, it voids the warranty and it MUST be installed by them. No refunds/or exchanges. I had bought this product from there ONLINE STORE, and no-where on the site does it say that installation voids warranty. So this is my arguement... The deck has a dead channel on the pre-outs... something my install would never effect. The Store manager told me he could do nothing for me except send it for repair... but why should I repair a BRAND NEW DECK. anyways, I got argumenitive and voiced my opinions to the other customers and got walked to the door of the store and told never to set foot there again. I've spent about 4g there within the last 2 years buying electronics so I'm not impressed. What do I do if I need to warranty my 50" TV? Stand outside and yell for help???

Anyways this is why I'm asking what the legalities are. Is there anything legally written down somewhere?? Can they get me arested if I go in?

edit: Ah, the store manager lied to visions canada head office and said he visually looked at my wiring and told them I hooked it up wrong and burnt the unit out. The head office now refuses to help me. Alpine Canada send me a PO number for Visions to swap units but visions also refuses to do the swap.

A) People ALWAYS drop the "I've spent XXX dollars there" line but the fact of the matter is, so has EVERYONE else. Being an ex-employee of Future Shop, that line ALWAYS loses respect.

B) Just because things are not going your way, doesn't mean you have the right to disrupt business and effect other people's shopping experiences. That's not fair to them and you will most definitely be escorted out in a situation like that.

C) The smart thing to do would've been to simply have walked out of that store and gone to another Visions (if there are any left LOL) and asked them to refund it. (How many days had you had the unit for?)

D) If the unit is scratched in ANY way from your install, if it is not the same condition as it was BRAND NEW, you most certainly will not be able to return it and it will be sent out for a warranty repair. Perhaps Visions would've exchanged the unit for you with Alpine's PO Number but since you made such a scene, they are now refusing to help you.

E) Even when a customer is kicked out of a store, their intentions are not generally to ban that customer from ever coming back. Those measures are usually reserved for thieves not irritated customers such as yourself. If you came back in a calm manner and rationally explained yourself and your actions, I see no reason why they wouldn't allow you to re-enter the store.

An employee can tell you to leave, if you refuse it's assault by tresspass. The Police will show up and tell you to leave. If you refuse there, you'll be arrested for assault (by tresspass).

It's a civil issue, probably not worth the effort to go to court... I'd suggest sending it in for repair. $300 is a lot of money for a deck anyways...

This seems like such an easy solution and it REALLY is. I don't see why so many people fail to see other alternatives to bend store policies and think "legal action" or a letter to head office is the best way to deal with things.

easy solution if the next closest store was within a few hour drive. Anyways thats not the arguement at this time.

What if it's engraved?

What if you ruin the sticker in the process? Now you have two decks you can't return.

That is if they scanned the serial number on the receipt. Most stores don't do that. In which case, you would simply return the old unit with the old box using the NEW receipt.

Like I said earlier though, I am assuming that the deck is in PERFECT condition. If it is not, then you have your answer right there...Of course they won't return a deck that has marks on it.

Isn't it written in the printed material included with the unit that installation voids warranty or something to that effect? If it is, then you have no recourse.

...and yes, dropping the "I've spent $xxxx here" line makes you an instant douche, and the staff will instantly lose any respect they had for you. You're no different from any other customer - an over inflated sense of self entitlement will get you nowhere.

as long as the "body" is good to go you can just swap faceplates with the new one and still return it lol

What would be the point in swapping the faceplate? Swapping the faceplate makes no sense at all. Especially since serial numbers are engraved into the deck itself. If the unit is mint you just exchange the entire unit with the new one and return the one that is defective.

ONLY IF the unit is mint, of course. Then again, if it's mint, you could simply go to the store and say "I want to return this item because I no longer have use for it." That is IF you were under your return policy and IF the product is still in it's original condition.

I have a hard time seeing a store not returning a product in it's original shape installed or not installed.

The OP still hasn't answered whether the unit has ANY cosmetic damage to it. I am somewhat tech savvy but when it comes to electrical work, I am not too familiar with the technicalities. From my understanding, a dead pre-out will not show any sign of physical damage, correct? It makes absolutely no sense as to why a business would neglect you from returning a perfectly new conditioned item within their return policy.

As for self-installations voiding warranties, that is not true and there is a misunderstanding. When one opts out of the store installing the product, they then lose any warranty with that store and any warranty covering the installation component of the deck. However, if the fault is truly within the deck itself, it is covered under manufacturer's warranty (which would have nothing to do with Visions anyways.)

FYI, it's not vision and it's not alpine's fault, they are just lazy as fuck.

Alpine doesn't give a shit, it's call DOA and they are happy to process it, they're just making it hard for you.

You could call Alpine and complain to them and ask them for a solution. Don't cause a huge issue but just say you're extremely disappointed and you just want a replacement and you thought that was ridiculous.
