In my opinion, The car in the right lane is at fault. The truck never even touched the car. Icbc would deem it as single vehicle accident.

Action starts around the 1:00 mark

The truck didn't even check blind spot.

Notice as soon as the truck turned on the right signal, he switch lane immediately and turned it off like before he was in the lane.

Signal doesn't make you the dominate one. People suppose to signal before hand to warn people.

The right car can maintain, but the truck would have side swept him.

Our human instinct is to dodge and he lost control over that.

Notice, the truck was already in the right lane and didn't even realize\
The truck's mistake lead to this accident.

I disagree, just because the cars don't touch one another doesn't make it any less fault of the operator of the truck. My guess is that the car was traveling in the trucks blind spot just as the truck started to change lanes, even then its still the responsibility of the truck driver to make sure no one is in his blind spot and its safe to change lanes.

My view on it is the truck driver is at fault for improper lane change causing accident...

he might get a ticket if the cops shows up, but thats about all he is going to get. if the truck and the car didnt make any contacts, ICBC will always consider it a single vehicle accident.

i believe this is what you would call a "Ghost hit and run" where the truck driver initiates the accident although he made no physical contact with the third party vehicle. Truck driver should be at fault from the footage. However without footage/witnesses, the lexus would be a single vehicle accident imo.

in the video description, it says the woman and her two kids in the backseat were ok, the woman driver of the lexus just suffered a broken wrist.

i don't wanna say this but it seems she doesn't really know how to drive, she was almost tailgating the truck and braking a few times unnecessarily before the accident and then swerving outta control. i'm glad her and the kids are ok though.

Truck should be at fault for improper lane change.

I know it's been said before, but I'm really glad to see so many people stopped to help. The red truck nearly drifted into the bushes, but still did what he had to do.

In addition to what was mentioned above re: tailgating the truck and braking, the Lexus driver showed little sense of anticipation.

Although I would place blame on the truck driver, in a situation like that where you see a big truck coming up fast on the left lane, then proceeds to also follow close to the car in front, you could pretty well anticipate that there is a chance the truck would also decide to pass on the right as the Lexus did.

Easy to say after the fact, but I probably would have instinctually hung back for a few moments to see what the truck would do when the right lane cleared before going for a pass.

There's a reason why trucks should always stay in the right lane and only use the left lane to pass.

body on frame ftw

as for the lexus on the highway crash. i would suggest that the truck driver is at fault but the driver of the lexus was driving like a complete asshat especially if she had kids in the back.

tailgating the truck, braking, and passing on the right.

not to mention a quick tap on the brakes would have allowed the truck to pass her at the rate of speed they were going instead of jerking the steering wheel like a kid playing mario kart.

It would be interesting how ICBC would look at it. I always think that it is almost better getting hit by someone who is/would be at fault, then trying to avoid a collision and end up causing another collision where you may be deemed 100% at fault. Especially with no witnesses. If there wasn't a dash cam, then this would be a slam dunk single vehicle collision case.
