Speed ticket for 75kmh in 50zone was actually doing 69kmh

First of all, sorry for my poor English...

I just got a speed ticket today 146(3) "Speed against highway sign" at Chancellor Blvd (UBC).

To make long story short, at that time I was driving around 65 km/h and the car in front of me which was around 4 to 5 meters away was also coasting at the same speed. Few seconds after, the car infront of me started to accelerate as our distance gets further. A few moment after he sped up, a cop came out and pulled him over.

Taken by surprise, I was also being pulled over by the cop as he said that I was going 75kmh. I told him that I was doing 69kmh as my digital speedometer showed 69kmh when he came up and pulled the other driver yet he did not believed and said that their radar is more accurate. (btw I'm driving a Civic which has digital speedometer)

I still insisted that I was doing 69kmh and told him that the car infront of me might be doing 75kmh instead. The cop then told me that the BMW was doing 76kmh and I did 75kmh. How could that happen as I was driving at 69kmh and the BMW was clearly getting further away from me?

So, I am wondering is there any difference in terms of the amount of fined from doing 75km/h in 50km/h zones with 69km/h? Because right now I have to pay $138. Will it be lower if they correct it to 69km/h?

I dont think it makes a difference if you exceed 1km/hr till 29km/hr. Exceeding speed limit by >30km/hr more significant and severe with penalization.

Your ticket doesn't seem so bad. I got ~$170 for going 95 on a 70 zone.

no it wont be lower because its the lightest fine for speeding.
just pay it, you wont win since you were actually speeding.

if you were going 90 then you wouldve had to pay $368 and get your car towed for 7 days ($250 impound fee)

and he most likely gunned you far away, by the time you notice the cops and looked at your speed, you have already slowed down.

so, no point for disputing it? any chance for getting lower fine? saw few people said that if you dispute the ticket, you might be able get a discount.

I am not familiar with the system as this is my first time.

You don't know exactly when the reading was taken so you might have been doing more than you believed. When people see a Cop the first thing they do is take their foot off the gas, then look at their speed. 6 kmh is nota lot of difference..besides, the Police Radar?Laaser is accurate to within +/- 1kmh and is designed to be used to get individual readings of cars in groups. They are accurate to within =/- 1kmh. Is your speedo.

No. No. And no.

Even if there is, you already admitted to driving at 69km/h. Just pay the ticket and take it as a lesson learned.

No, speeding is speeding. Whether you're 1km/h over or 100, it's still speeding.

Is there even a difference between being ticketed for going 69 and 75?

^ no lol cus he was still under the 30km, but still speeding. And to asnwer your question OP about 10km tolerance, it all depends on the cop and weather. i was being tailgated by a cop once, and i was doing 80 in 70. He never pulled me over

^ I think it's a bit harder to tell when a cop is right behind you
This one time I was heading to UBC, I wasn't sure if marine was max 50 or 60
So I was going btwn 60 to max 70. Didn't get pulled over either

Turns out it was 50 lmao

Then when I hit the high way (and road is now split into 2 lanes) cop went right beside me for few minutes. I think at that time he was checking if I was speeding or not. I knew the speed limit there so I was fine, and then he just drove off.

how do you not know if a cop is behind you ? i saw him pull out and come behind me, not too hard to miss. but i always keep in my head that they will tolerate 10km or less, so thats why ill speed up to over 10km max -shrugs-

Regardless 69 is still speeding, and deserves a ticket. I think the amount fined was very fair to the speed you were dinged for/driving at.

Oh and I'm not 100% sure on this so correct me if I'm wrong... anyone, but I heard that digital speedometers are not as accurate, as compared to a normal speedometer... could somebody confirm this? Jwing...

Going over by 10 and as a result of being tail gated by a cop. Is that something that you can go to court to fight for?

"Being tailgated by a cop" is not an excuse for speeding.

Is there any truth that the reading from the Laser must be presented if requested?

And if so, as in the OP's situation can the officer produce both readings?

if you dispute the fine amount you can get a reduction in court. I always dispute the allegation, that way if the cop dont show i get to walk away with nothing, but if they do show just admit your guilty and talk nice to the cop and you will most likely get a fine reduction because they will always try to sucker you into admitting your guilty before the trial starts
