My friend just got detained for shoplifting and now has to pay, any help?
 
sorry if this is in the wrong section. he just got detained and got a letter today saying he has to pay $595. i dont know the details if he signed anything or not tho, does he have to pay?

Did he steal a $595 object, walked home, and now they want him to pay for it? Or did he get busted in-store stealing a $595 object.. If its the latter, I'd imagine they would take the item back. What's with the $595, then?

If you're detained for left under 5,000 regardless of the value of the object, even if it's a $2 pen or something, you would have the item confiscated and be charged a flat rate. Generally when you are detained you are held until an officer is present.

The real question you should be asking right now is, why the fuck are you friends with a shoplifter?

He should admit his guilt, pay his fine, and live as a law abiding citizen before his ass ends up in jail.

^ I don't necessarily agree with this. I used to shoplift quite often. You'd be surprised how many people do. That doesnt in any way make it right, but i think it depends on the scale of whats stolen. Law abiding citizen? How many people steal time at work? Jaywalk? Drive over the speed limit?

The letter your friend received is from the lawyer for the store/mall/establishment where you friend got caught for shoplifting. The $595 it's talking about is the store's right to claim civil recovery/damages against your friend. This is different than the criminal charge of Theft under $5000, as this is 100% civil.

If you friend does not pay the $595 the store/mall/establishment can exercise it's option and proceed to make a claim against your friend in small claims court, and attempt to recover the amount from him there. It doesn't mean they will proceed against him, it also doesn't mean they will not.

If this was that easy to just pay 595 and get away from it, they wouldn't have called the cops and all.

it's not that easy.

theft under 5000 or whatever it is, you get detained, the person can write a record and sent to VPD and they keep it as a record.

VPD has the right take you to court, but of course, most of the time, it's a no. no one will just waste thetime to take you to court if you stole a bar of soap.
