Vandalism and icbc

I'll find out soon enough and will update, but if anyone knows, please say

This am, 2 shits keyed our car, we saw them, went out and caught them

As good citizens, we held them, called police and waited

Police show up, but are useless and do the whole 'not enough evidence' thing, even though we have an eye witness and they could easily have searched and found keys with paint chips on them (even if small)

Now, charging them is not my concern, they're punk kids, hopefully this will scare the, straight, but will we have to pay the deductible to fix the damage, even if we have police file number, name of punks who did it, eye witness (family member), etc?

I sense an ICBC screw over coming

Yup!

Had a girl break the front door to our building, saw her being hauled out of the party, straight up drunk off her ass...police come...and....escort her home.

The girl is 18/19...huge record already...but no one actually witnessed her with her foot directly through the front door, so no dice.

ICBC will totally bend you over.

yup sounds like an up coming icbc fuckery.
bring your own lube they probably wont provide.

I think you can tell ICBC to send a letter asking for the deductible to those punks, but its all luck because its just a letter requesting them to pay. If they dont pay collections will look at the evidence and either force them to pay, or go "well not enough evidence, so you have to pay it" which i would investigate this route since you are considering paying the deductible anyways.

Thanks for the responses, isn't it sad that innocent hard working ppl get screwed over time and time again by poor police work - they couldn't even be bothered to at least try... We saw them do it... We even took the high road and called the police, I bet many would just take actions with their own hands

Guys...come on...easy to handle.

All you need to do is catch them in the act. Then simply take a video recorder, with a date stamp, and film them in the act, grab 2-3 impartial witnesses that don`t know you to identify the act, as it happens and then sign sworn statements. Then hold them for the police to come.

Then, they will spend a night in jail, get released to their parents, who of course won`t believe that little johnny had anything to do with it and in court, they`ll plead to 10 hours of community service.

And you say the system is broken.

I don't see how ICBC is screwing you over in this situation.

Wouldn't the first screw over be the kids that keyed your car? Also wouldn't the police be the ones screwing you over in the end by saying you have insufficient evidence?

I know how it feels to have been keyed, hell, i got my all sides of my car keyed 2 months after i bought my new car. I never once blamed ICBC or felt that i got screwed by ICBC even though i paid my $300 deposit for them to paint my car. The situation sucks but if you have comprehensive then insurance is there to repaint your car.

When it comes down to it, ICBC gets the information from you and the police, so if the police say there is not enough evidence and plus you're not laying charges then there isn't enough there to force someone to pay. You can always take the kids to small claims but i'm pretty sure you would be wasting the courts time.

My 2 cents.

^in Canada, citizens do not lay charges...

also, in bc specifically the rcmp/munies do not lay charges.

they recommend charges in their rtcc and then crown decides whether to pursue charges or not.


i'd say you'd have better luck contacting local media outlets and expressing your displeasure with the system.

you could try going through small claims at best to recoup your losses?

I agree entirely, the kids screwed us over first, police screwed us over by not at least trying to scare them into admitting it and paying for it (at least take the home in a cop car and talk to the parents) - but my frustration is that ICBC will make us pay the deductible even though we saw them do it and caught them in the act, I don't care about charges being laid - it's not a 'serious' thing, but they should be made to pay it

It's also way more about the principle than the $300 - $300 isn't a 'lot' of money, but the fact that these punks got caught red handed yet can walk away infuriates me

Really, ICBC should eat the cost and go after these punks - why should we, as tax payers have to pay when we have the punks who did it? ICBC should go after them for the entirety of the cost to fix it


What this also teaches me is, next time I won't show any restraint, the system is broken, so I'll allow street justice to prevail

Sucks, but you should have made them give you their ID to get their name and address.

These kids may or may not get it. In fact, now that they got away this time they might just consider it a close call. For some, this is just a part of growing up and later they'll smarten up. For others, this is the start of their path into criminal activities (i.e. starts with keying/breaking into cars and later leads into other things).

i disagree - not about charging the kids, that doesn't concern me, but the police should have put them in the back of the car, taken them home, and scared the shit out of them by talking to their parents.

if these kids come from a non-shit family, hte parents would beat teh shit out of them, nad likely would make them pay up... that would have been good police work - justice served, and no waste of taxpayer dollar

Take the kids to a bank machine, and get them to give you the $300. Or hold them and make them call their parents... on your phone, so you have the number in case there's any retribution.

It's about covering your ass. Doing things "the right way" as you found out, only screws you. Not them.

I caught a junkie breaking into a car in my back alley one night. I knew it wasn't his car - it belonged to a sweet little ol' lady who lived in the building next door to me. He claimed his battery was dead and he needed a jump (he was asking me for help). So I helped him limp away from there - I smashed his knee cap in with a baseball bat. Go ahead junkie.. call the cops.

Oh, its for you to have, it might come in handy....

at the very least you could call their parents yourself even if the police do nothing.

what does calling them do? they're probably just hicks who will tell me to go f myself... there was a reason i wanted the police, you know, the people we pay to serve and protect us (including our assets), but yet again the police have proven to me that they are useless here.

next time, i'll just take care of issues without bothering any lazy civil servants

It's hard to call them lazy police officers. Honestly, if you actually want to charge them, it actually does take quite a bit of evidence - and thousands of taxpayers money. DA's (I don't know if they're called district attorneys here), probably a defense lawyer appointed by the crown, etc, etc.

I know it's the principle of the matter, but the police has to provide enough evidence for the lawyers to prove beyond a reasonable doubt. Might be easier for you to actually take this case to civil court to get your money back.

The police (i think) can hold those kids for up to 24 hours without formally charging them, but is that overkill? Civil rights groups would be all over them in a second.

Slighty off-topic but a while ago someone broke into my car to steal my FACTORY navigation system. WTF?

However, the police officers in my area were municipal and they were extremely helpful, following up on me, calling my manufacturer/siriusXM to lock the navigation system based on the serial number. If your police is RCMP, probably cause they are always short-staffed they can't do much about it.

^^That is really true. We've had to call the NWPD a few times and they have been fantastic to deal with(outside the front door being broken issue, but I do get their point on it.)

We had to call them the other day as a tenant in another building lost his shit and threatened to burn down the building. They came, talked us through it, acted as a witness for signing some papers and were super helpful.

About 2 years ago, I had a heroine addict that was sleeping on the balcony of the apartment that I had finally kicked him out of, and the Burnaby RCMP were rude to me, super friendly to him and had the nerve to ask, "why did you kick him out?"

Hi. Heroine addict? Trashed the place..currently spending 1000's to rehab it after his 2 month stay alone in the place..we had to pay people to remove needles and other people to clean arterial spray. Fuck dude. I don't know. I'm just mean(I didn't actually say that)

It was so frustrating. So I was left re-renting an apartment that may or may not come with its own pet junkie.
