| Looking for Workplace Harrassment Lawyer
I have been off on a WCB injury since the 2nd of Aug. Claim is completely legit with MRI showing multiple tears in knee. A few other people got hurt around the same time I did so they had a safety meeting in-front of the entire job site complaining about how much this is costing the company every time somebody is off work on WCB. Then at the end of the meeting in-front of about 50+ people they made the comment how I'm costing them money and the superintendent said " If anyone has any dirt on Jeremy com forward now " Everyone laughed and it made me feel like they are singling me out and are after me and I haven't felt the same since. I reported it to WCB but they said they cant do anything until the 1st of Nov until this new law comes into effect and advised me seek out a lawyer If i wish to seek any harassment lawsuit or whatever. That's the long story short.

Unless they singled you out for being one of the "usual suspects" of being a minority, or sexual identity or sex then you will find that there just aren't enough teeth in the laws to justify what you are looking for.
I'm no lawyer, so take this with the nickel that comes with free advice. They made a comment that you are costing them money for being on a WCB claim. They can say this is a true statement. They can ask for any information relating to any inaccuracies in your claim from co-workers. This is soliciting information.
Was it inappropriate? Hell yes.
Was it illegal? Doubt it.

Also if you think that was bad, try coming back to the job after you try and get a lawyer involved.
WCB claims do cost companies tones of money which is why in most cases they will try to find you alternate duties to do instead of just sitting at home. Hell, I've seen guys in wheel chairs counting nails before Posted via RS Mobile |

They singled me out because they want me off WCB so I wont cost them anymore money. I am going through a hard time and I am furious. If I don't do something they will keep harassing other people and It needs to stop.

Actually, harassment claims can be claimed on WCB in the next couple days. Theres very strict guidelines about it, but its new regulation. I smell abuse of it however. Posted via RS Mobile |

Next time just record the whole thing. Play it to your boss and mention this is going online and going to be on different raido stations and TV shows. Might not have much affect with your case but compnaies hate negative publicity if enough smoke comes up they might give you a nice package for you to leave.
Remember Hotsuite how they were not paying thier interns and it got the the media...... yea.

Most companies hate for employees to go on WCB because that sends their coverage costs through the roof (Yes, companies pay for WCB coverage, just like insurance or bonding). That's why a lot of companies will pay their employees their regular wages, while they sit around and do nothing, or while they try to help out in the offices or something.
If they offered to put you on light duty and continue to pay you, then I can see why they would be singling you out...
Remember that once you come off WCB if you have been a whiny little twit they will fire your ass, and say its because you suck at your job. Companies don't want people who are not going to cooperate with them.
And by the way I was on a site where we had a series of incidents, and my company held multiple safety stand-downs where they talked to everyone about how these small incidents will one day turn into a big one. This is normal procedure for any HSE team on a site, if you have accidents you bring it to the attention of everyone in the hopes that nobody makes the same mistake. You are making it seem like they called a meeting just to ridicule you.
Truth is, your in construction, people will make jokes you don't like all the time (I am pretty sure thats all your boss was doing, making a joke). People at my work call me car bomb (I am brown). You don't see me being a bitch about it and filing a harassment suit. I just call them a hillbilly or white trash and everyone has a good laugh and gets back to work.
Seriously I think you should download that hurt feelings report and fill it out. Then your boss can rip it up in front of you and you guys can all move on from this....
EDIT: Oh and as stated by someone else above, once you get a lawyer involved if this does end up going anywhere, you risk alienating yourself from almost all other construction companies. Unless whatever company your working for is some sort of joke, who doesnt have any pull in the industry, he will end up talking with others about this and at that point you can pretty much kiss another construction job goodbye...

That is not harassment, as others have said, seems like your feelings are just hurt and you might be a tad sensitive. You need to toughen up and grow a thicker skin or you'll never survive in the world.

OP, I understand where you are coming from but personally, I think he was just cracking a joke and even if he wasn't, truth be told, there is very little you can do. I've talked to many senior HR people before and the way the laws are written, there is little you can do. Either grow thicker skin and don't let it bother you, or move on to another job.
