One high beam only?

It is a popular mod around the world for BMW E30 to have one of the high beams removed to hook up an air intake there.

Is it legal to do so in BC?
Is it legal to have no high beams at all?

Thanks

I'm going to say "no and yes"

We agree on no single high beam or "upper beam of light" because:
4.05 (1) A motor vehicle must be equipped with either one or 2 headlamps mounted on each side of the front of the vehicle and capable of displaying white light.

However, you say no to the second question because:
4.06 (1) The headlamps of a motor vehicle must function so that the driver may select lamps capable of displaying
(a) an upper beam of light which, regardless of the load on the vehicle, will reveal an object at a distance of 100 m, and
(b) a lower beam of light which, regardless of the load on the vehicle, will reveal an object at a distance of 30 m and the high intensity portion of the lower beam will not strike the eye of an oncoming driver.
And are concluding that means that you must have a pair of high beams available.

But then I say yes because:
4.07 Despite section 4.06, a motor vehicle, including a motorcycle, may be equipped with single beam headlamps instead of multiple beam headlamps if
(a) the illuminated headlamps reveal an object at a distance of 60 m, and
(b) each headlamp is mounted and directed so that the high intensity portion of the beam is, at a distance of 8 m from the headlamp, at least 12 cm below the height of the headlamp and, at a distance of 25 m from the lamp, not higher than 1.06 m from the road surface.

Therefore, if your two outer lights comply with 4.07 and your single inner lamp is disconnected, there should be no problem.

Thank you for the great info!

However, If I look at 4.05 and 4.06 it seems to me that having 2 Low beam lights AND 1 high beam on at the same time does not go against the regulations.

"2 headlamps mounted on each side of the front of the vehicle and capable of displaying white light." - 2 Low beam lights
"upper beam of light which, regardless of the load on the vehicle, will reveal an object at a distance of 100 m" - 1 High Beam

I do understand that even if it is legal it will, certainly, attract more attention from the peace officers...

ive driven without bumpers and had exhaust out my hood for months... also dont have a front plate on my DA cuz the hardware for the plate to mount too is gone but i have had no trouble ever

drive proper and dont attract attention to yourself and the cops may just leave you alone. thats just my experience though

its nearly impossible to mod your car and keep it legal. so if you wanna keep your car legal you want to switch hobbies

Nope, afraid not. 4.02 (2) takes precedence. You cannot remove lamps from the vehicle.
4.02 (2) A vehicle on a highway must be equipped with lamps equivalent to those provided by the original manufacturer in accordance with the requirements that applied under the Motor Vehicle Safety Act (Canada), or a predecessor to that Act, at the time of vehicle manufacture.

^Correct.

If it came on the car, it has to function.
