What to do when my employer does...

Hi,

It's my first time working for a small business (him and I) and it's my first time coming across these issues (I have searched the gov websites but haven't found much, I guess the terms I used weren't correct):

1- My Employer, is the only one with the keys, shows up an hour late, do I get paid that hour waiting outside?

2- My employer announces he's taking a day off on Friday. Am I allowed to object?

thanks,
Nic

strike

His business is going to go under with that kind of work ethic. Quit now or quit later, your choice

To add to that, they seem like the people that won't pay you on time or at all. I'd get out while you can

Yeah I've been looking, I'm out as soon as I find. In terms of pay, they pay in advance with a post-dated check. At least I know when I get the check that my hours are guaranteed until that day. It happened twice so far in 4 months that my boss called for a day off, one of which did not happen thanks to customers who wanted appointments on that specific day. Tardiness did not happen yet, though it gets very close at times, I know it's going to happen, wanted to know what to do in that case.

Thanks for the input. I hope someone will have some "legal" advice, if any applicable.

Yea, I think its either 3 or 4 hours. Only ever happened once in my life way back in the day at Playland when we got rained out. Heck yea

What kind of business are you in if you don't mind me asking, that one could just casually decide not to open up shop or open late?

The cheque may be post dated but if he closes the account, its just scrap paper. Why not ask your boss. You can probably tell what his mentality is with his answer.

Yeah that's what I thought, in QC it's that way.

Bad joke. That would not be useful to anyone.

It's 2 hours here in BC if you're called/scheduled to work, but they say they don't need you. (Employment Standards Act)
Can be 4 if you're scheduled for an 8+ hour shift.

There is a lot of information here for employees; give it a read when you have some time! Think they answer the most common questions in a (slightly) easier to understand context compared to the act which may be a bit convoluted times.

1- My Employer, is the only one with the keys, shows up an hour late, do I get paid that hour waiting outside? -- YES

2- My employer announces he's taking a day off on Friday. Am I allowed to object? -- NO; it's his business, he can do whatever he wants.

If you don't like where you work; leave.

or strike

Have you asked him for keys to the office so you don't have to wait outside? Was this a singular instance or re-ocurring? How long have you worked here? Has this type of behavior been prevalent since you started?

Depending on the answers to these, you should probably just go work elsewhere, sounds like this guy doesn't understand how to run a business or frankly just doesn't value you or care about you.

For example when he told you that he was gonna take friday off, did he say what you were supposed to do? Was it like "hey lets take friday off", or was it "hey I'm taking friday off, fuck whatever you want to do".

I'd expect that with any business where you are only 2 people working together both people would have some say in these matters, obviously he's the boss, but being that there is only two of you, whatever he decides should be ok by you. This isn't a law or something you would see on a government site, just a matter of not being an asshole.

The only example I can think of like this, would be like a small contractor, like someone who builds fences, or mows lawns hiring some young guy as labor. If he had any respect for this young guy he would appraise him of the situation, and tell him "hey maybe next friday we might not be busy, you can take the day off." Or maybe he doesn't give a fuck and that laborer is completely replaceable by any clown off the street, so he just says "Hey next friday don't fucking show up, I'll see you monday, Maybe".

Get a key.

From my experience (very similar to yours), the guy who started this business didn't know fuck all about the industry nor the knowledge or experience in the field to run the business. He opened up the business, I was the only one in office. Damn guy still works his 9-5 job while trying to "run" this business when he's like 90% there.

If he's serious about the business, he should be putting in more hours than you.

If I were you, i'd gtfo asap. It's a waste of your time.

JesseBlue 07-10-2016 10:23 PM

He has another hot employee doesn't he?

tinico 07-12-2016 05:51 PM

Agreed with your inputs, thank you very much!
I know what I have to do now
@Armind, don't know why, but I don't see a "thanks" button for you.
