car deposit for dealership

so what happened was I placed a deposit down for a vehicle I really wanted so we signed the papers, and placed a deposit down that was non refundable. next two days I saw another vehicle that was a better deal on craigslist, I called in and they said no refund, I totally understand that since I signed it, is there anyone who had a the same experience but still got there refund back?

Did you sign a non-refundable deposit form?

If you did, you're out of luck. Stick with your word.

If you didn't sign anything, then they have to give you your deposit back.

You should stick with your word, regardless, but whatever.

You answered your own question.

You signed a form which said that the deposit is non-refundable. You phoned to see if they are willing to refund anyways out of goodwill, they said no.

I guess you can try to go in and plead with them, but depending on the person/company more than likely they will tell you to get fucked.

Read what your contract says. It probably is not refundable if you chose not to purchase the vehicle from them. Is the Craigslist one that much better though?

i have gotten money back because nothing was signed. If you signed something that said no re-fund you aren't getting it back.

i've gotten non refundable deposit back i paid for tuition cuz i wrote them a very convincing letter.

there is no such thing in British Columbia as a non-refundable deposit.
No matter how many and what forms you sign.
Your deposit is 100% refundable and must be done by the dealer.
If they don't cooperate, you should file a complaint with the VSA and BBB.
it will take time but you'll get your deposit back.

Depends on the dealer. When my Parents bought their CX-9, Mazda Port Moody offered to not let us sign the non-refundable deposit part in case we didn't want to go through with it as my Father wanted to talk it over with my mom first.

This is of course after the fact now, but I'm curious as to why the OP did not insist on a refundable deposit. If a dealership insists on giving them a non-refundable deposit, I would walk. It isn't like they're the only game in town.

We don't know... but I am guessing is something that was limited edition

Maybe it was a 1M, GT4, GT3RS type of thing.... because the OP did mention craiglist... makes me think that at the time of the deposit... he had no other choice... and then a better one was posted after he has paid the deposit to the dealer...

Did you use a CC to pay the deposit? If so, do a charge back.

I find that AMEX usually sides with the customer the most versus VISA or MC.

He signed a document that said it was non-refundable even if he did charge to a CC, if he asks for a charge back that's fraud.

That is the same as going into a store, getting a pair of sunglasses, walking out, then phoning and doing a charge back. You essentially stole those sunglasses.

Charge backs are reserved for when you paid for something and the item was not received, or damaged when you received it, or situations along those lines.

In this instance OP purchased from the dealer a period of which they would hold the car for him. They did so, and now OP is choosing to walk away from the car. Both sides duties are fulfilled, and both get to move on from this.

FYI fraud on a charge back will not only end with your CC most likely being cancelled, it can also end with an individual taking a huge hit in their credit rating.

this is why i never sign deposits if i am not 100% sure...


why even bother going to craigslist if you paid and signed already? either do that before you sign / pay or DO NOT visit craigslist. You will hurt yourself emotionally after seeing any better deals

dont you love it how stealerships will take your deposit, no problem, and sell you a car for agreed price.

but when you pre-purchase a car thats released next year lets say, for lets say 70K agreed price
then for whatever reason that car goes to 95k, they will not sell you the car for 70k

cough, 2017 nsx, cough

Thats kind of a different situation though. On the NSX your putting a deposit on the right to purchase the car and be one of the first people to own the car before it arrives. Not to make a commitment on the price of the vehicle. Most likely the dealership would love to sell you the car at the price you wanted but dealerships buy cars from manufacturers and sell them to the public and they most likely couldn't buy the car at $70k when it's msrp is $95k since that is what the manufacturer changed the price too. In those cases you can always refund your deposit and give up your spot to someone else.

The "stealership" could of lost potential sales on the Car that the OP was gonna buy because they had to turn away other people interested because of the deposit already on the car. They took a risk on the OP's word that he would buy it and now he is backing out. Ultimately it's up to the OP's and the dealerships decision on the deposit. Some dealerships will always give back deposits on vehicles if it isn't a sale. Some are less likely.

MSRP is not what the price dealers pay, they pay less than that (dealer invoice). Off topic but wanted to point that out

He won't get his money back asap. The money will probably be held for a few months. In the mean time, he will not be charged for the money until it is reviewed.

Regardless, it has worked for me and I use it to protect myself.

Sadly, it works well for scammers on paypal purchases or ebay who would say b.s. reasons on the product they purchase. Then, they would ship the wrong item back and get away with it.

It's a viable option that has saved my butt a dozen times. Like I said, I like using AMEX the best.

No one is questioning if, in general, chargebacks work. But in this specific scenario, a charge back is fraud, and the equivalent of stealing.

yes even with a non refundable signed you are still able to get the deposit back.
Talk to the dealership and if they say no, bring it up with the MVSA and most dealership will refund back to you.
