Working overtime on a stat? Just curious if anybody knows the official answer, if you work overtime on a stat day, shouldn't I qualify for double pay? I mean if I worked regular overtime on a regular day or worked regular time on a stat day, I would have automatically received time and a half. Therefore, working overtime on a stat would qualify me for more pay, would it not? I worked OT on a stat for my company and they only paid me time and a half |
Was that OT over 40 hours for that week? Correct me if im wrong, and I may be, but overtime is over 40 hours, not necessarily over 8 on a day. |
I think you get more pay on the stat if you worked for 15 days in a months time pior to the stat. So say you worked for 15+ days, you'll get paid the stat, then get paid your regular pay if you work on the stat and then get OT pay on top of that if you worked OT on the stat. I remember it was something like that, I might not have wrote it 100% correctly though. |
Well normally on a stat week I work 32 hours and get paid 8 hours stat. I work for a chain pharmacy, so another store called me in to work on the stat day. So in total I worked 40 hours + 8 hours stat, but the shift I worked on the stat was techincally an overtime shift. You would normally get paid time and a half for working on a stat day as it is without overtime. I guess it depends if they consider me working the extra shift as overtime or not, since technically I only worked 40 hours that week + 8 hours stat, but normally on stat week you would only work 32 hours? |
so you didn't work overtime, you just worked the stat?... the first post sounded like you worked overtime on the stat. As in over 8 hours on the stat day. just working the stat. I think you should get 8 hours at 1.5 times plus the 8 hours stat. so basicly you worked for 2.5x that day. |
BC Labour Law states that working a stat, you will be paid stat pay plus whatever your employer agrees to. Some employers will pay straight time + stat. Others will do 1.5 + stat. Mine is good enough to do 2x + stat. |
hey jermyzy, I don't think you'd get double pay in that situation, since the 8 hrs of stat pay isn't really work. I worked the stat too and got my stat pay, time and a half on the day of the actual stat, and to top it all off, I worked over 40 hrs because I did some presentations and such that week. I think my total hours count was about 52 hours (44 regular hours plus 8 hours stat pay)... but none of those hours ended up being double time. I think you could probably argue for double pay if maybe it was overtime ON the day of the stat. i.e. more than an 8 hr shift on the day of the stat. But since you're not technically really "working" over 40 hrs, then I don't think you're entitled to double pay anywhere... even if you worked over 40 hrs that week, you'd probably only get 1.5x pay |
At most places you get 1.5X if you work a stat and on top of that you get 8 hours pay (assuming you're fulltime) for the stat. Basically get 8 hours pay of you don't work a stat or 20 hours if you do. My place if we work stat we get double time plus the stat and a lieu day (paid day off). So we get paid for 32 hours if you count the paid day off. |
all the places i have worked at pay out as follows: if you are eligible for stat pay you get a full days pay (1x) regardless of whether you work that day or not. and if you work the stat, you get an aditional 1.5x. so overall you get 2.5x for working the stat. i will see if i can dig up the particulars on stat pay in the employment standards act later on today. |
My company is a little weird...on a regular week if you work more than 40 hours, it's considered overtime. So I figured on a stat week anything over 32 hours is considered overtime, but it looks like it's not :p |

I have an overtime question. I didn't want to start a new thread so I'll bump this one. I seem to remember, maybe 10 years ago that if you came in and worked o/t. Lets say 2 hours. You have to get paid for at least 4 ours. That a company can't force you to come in and work for 1 hour and only get paid for 1 hour even though you probably spent 3 hours coming/going/working. I searched on the BC labour site but I couldn't find it. Any one know about this? Thanks. |
I think they changed it now so that they only have to pay you 2 hours, instead of the 4. |
