Employer Not Meeting Employment Standards A friend told me of the following; the small bbt cafe he works for in the mall has worked him to death and he doesn't know what to do. This his first job since he's from Hong Kong and isn't that great with the English language... From what he has told me; (1) the Owner has not paid him for the Training hours. (2) He has worked 6-7 hour shifts without a break and unable to as the manager is not there to let him go. Not sure what other rules he may not have been in compliance with. I doubt paying once a month is an issue, so I'd leave that out? The owner has also fired him than 3 weeks later hired him again and made him retake training which seems ridiculously? What agency should I be speaking to regarding this matter? The total owing for training hours is around $300, so it isn't worth it to take it to small claims court as there are fees (i may be wrong?). Any advice would be great...~ |
he needs proof of hours worked + trained vs hours paid there should be a contact information page on bc labour |
i thought employer must give workers break at least 15 minutes after 4 hours or something |
is he working legally with a SIN # or under the table?... |
haha, the first line answered it all, working for a bbt store which means an asian boss. every asian boss ive worked for has never followed the rules. so reconmendation, learn his/her english, and find himself a non asian boss. |
you're suppose to get paid bi weekly... |
if he's being paid under the table, then i think he is out of luck. there's nothing u can do about it. never, ever, work for an asian boss. |
yea if he;s working illegally he's SOL. he could get them in trouble for hiring illegals though.... or... report some food safe violation.... |
or he can fuck boss/owner over by reporting them to the tax agency saying the boss/owner is evading paying taxes. |
Okay no he is NOT working under the table, receives a pay stub monthly, he does use his own SIN #. I told him to follow by the rules or else if sh*t went sour, he could get owned. The Manager is NOT Chinese/Taiwanese btw.. I called the Employment Standards Branch yesterday and they said to try resolve the issue prior to calling them. I DID do this a few hours ago on behalf of my friend, and well the bastard Manager called mall security on me. So I guess Employment Standards Branch will have to deal with this now? |
