Does penalty points transfer?
 
Hey, I was wondering if penalty points transfer?
for example: i acquired 5 penalty points when i was a Learners (L) and now im currently a New Driver (N), as i recall a New driver is only allowed max. 6 penalty points, thus if points transfer from L to N then if i get any violation that may add penalty points, im guessing my license will be suspended correct?

edit: i just remembered that before i was able to take my N test, i had to pay fee for the penalty points that i racked up during my Learners. Technically those should be cleared off?

Yes. Only time will erase those points.

I keep explaining that points are only a method of keeping score of the seriousness of the violation convictions contained in your driving record. ICBC assigns a penalty point fee based on how much these add up to. The Superintendent of Motor Vehicles uses them as part of the Driver Improvement Program to decide if you should be prohibited or not. They don't go away any more than your driving record does, but are only taken into account by ICBC and the Superintendent of Motor Vehicles for certain periods of time as they state in their schemes.

i see

because I have acquired 5 points before, and last night i acquired another 2 for another violation, technically the cop would not suspend me at the scene, and now my only hope is to wait for the superintendent of motor vehicles to determine if i am prohibited or not?

Yes. Chances are though, you will be suspended. The officer does not have the authority to suspend you at the scene but the super does. You'll probably be receiving a letter in the mail soon from them asking for your license.

He already has been suspended.

Sidebar question, penalty points are only awarded once your found guilty correct? For example if I got a ticket 5 months ago, and the court date for it is only probably a year away, I wouldn't be paying the penatly fees unless Im found guilty correct?
