Had my letter from collection agency about 2 weeks ago. Set that one on fire too. |
the real question is, on what authority does ICBC have to give out your personal information for the collection of a debt to a private corporation (like all these private parking lot companies are)? i don't really see anything that would support such a disclosure in the BC Freedom of Information and Protection of Privacy Act. A lot of these companies will claim that simply by entering their parking lot you have implicitly consented to their terms and conditions but the according to the FOI act, there is no such thing as implicit consent. it has to be written. some parking lots give you the terms and conditions on the ticket you buy but that's AFTER you have purchased the ticket, not before. someone needs to challenge ICBC on their authority to simply hand out our personal information (like our names/addresses/phone numbers/etc) to private companies. as an aside, the FOI Act does allow ICBC to disclose such information to public bodies (like the City of Vancouver, the various police agencies, etc) for various reasons (like the collection of a debt). |
One thing to note, is that if the balance has been sent to collections, the amount owing cannot be owed to two different parties, therefore, if the collections company is trying to collect, Diamond is not legally allowed to tow your car, regardless of how their parking lot disclaimer may be worded. (Collections company may be allowed though,...) I also strongly doubt that diamond/wiggins, can or will leave any feedback on your credit history. But really, if you got a parking ticket, just pay it. They dont usually give parking tickets to people who aren't supposed to get them. |

I was under the impression that this thread was about private parking lots in general and not specifically Diamond. I supposedly parked in Impark's lot, so Impark gave me a ticket for parking in their lot. However, I was not parked in anyone's lot that day so what I'm assuming happened is that they recorded down the wrong plate #. |
LOL the funny thing is there's 4 drivers in my family, and we get calls from Wiggin's Adjustments everyday. what a nice year it's been. |

My friend and i each got a ticket from Impark a month ago. I tossed mine on some store's roof right when i saw it and told my friend to do the same. He chickened out and after a week he paid the ticket. Just got a letter few days ago that my ticket is now $89 for $45, threw that away. I think they called too but my mom deleted it. Im going to grab a new plate soon =D |
remember that icbc is giving your name, phone numbers, and home addresses to these private corporations (without your explicit consent)... so even if you change your plates, they'll still be able to link the plates together. you might escape the immediate tow i suppose. |
Isn't getting new plates from ICBC about $45? If so why not pay the ticket if you know early enough about it and keep your plates? Companies like DPS will also eliminate the extra late charges and allow you to just pay the original amount even the collections companies will also, you just gotta ask and make it clear if they don't then they won't see a penny from you. |

Both parents have received letters from ARO Collections, in Kelowna?. They're saying we owe the City of Vancouver XXX.XX amounts of money from like 2005. Serious business? |

I got a ticketed once. Think around years 2005. I parked at safeway by kingsway and joyce. Decided to drop by starbucks across the street for a quick capp. It was raining that day, so got back to my car, started my car, flipped my wiper switch and saw a piece of paper swiped across me from the passenger side and flew off. Month later i got a call saying i own them money for parking in the lot but not going into supermarket. I told them i didn't get any ticket or any sign of note on my car and i ain't paying shit just cause you said so. Few days later it hit me, so that piece of paper was the ticket. If that ass who wrote it and put it on the driver side i might had notice it and paid it. But too bad he put the ticket on the passenger side.
