i would assume so on the road, since cyclist are expected to follow the same rules as drivers. Grey area unless someone can say otherwise. |
If you're drunk and on a bicycle (or just drunk out in public in general), you're arrestable under the Liquor Control and Licencing Act for being drunk in a public place. Do you think that having your ability impaired so that you're not able to drive a motor vehicle properly means you're ability to ride a bicycle would be any better? It requires similar amount of motor skill, added in balance and less ease of maintaining a straight line. |

We've stopped a guy who was cycling while drunk before. Someone called it in because he was all over the road and sidewalk. He was only a block from his house when we found him, so we had him walk his bicycle to his house and called it a night. |

If you were really liquored, you could worry about this: Drunkenness in public place 41 (1) A person who is intoxicated must not be or remain in a public place. (2) A peace officer may arrest, without a warrant, a person found intoxicated in a public place. |

Even being drunk inside a bar is still technically a "public place" since anyone can enter whether the invitation is express or implied. |
