Story is I have a court date next week and I cant make the date as I have a final exam. I originally went to court in august but the evidence I requested was not available so it was adjourned. I filled for an adjournment and just recieved notice that it has been denied. Ive been doing some research and I can send an affidavit into the JP if I dont show up for court explaining my reason for not attending and then a new court date may be set or it may ve denied and I will be deemed guilty. Any other ideas on ways I can get it pushed to a later date? has anyone ever had luck talking to the officer before hand?

I assume since you appeared once in court and requested an adjournment, that it was granted as being a "pre-emptory" adjournment...that means this is your 1 adjurrnment and the trial WILL be going ahead on the next date, with, or without, you. That is the way I always agreed to any adjournment requests. Too many disputants try to play games...and it has beed discussed right here on this bb before..I'm not saying that you are. I have never seen a request for another adjournment granted as both sides get only 1...however I suggest that you contact the dispute process and see what they will do. With the backlog problems and officer availability...????? They might say that you had advance notice of some ? months to make sure you were available and you were told that it MUST go ahead on that date. Can't you get a rewrite date for your exam ? They may just say that you agreed to the date, were told that it WAS going then and it was up to you to live up to the decision?...or they may grant you another adjournment? Worth asking them .

sounds like the first adjournment was the fualt of the crown if it was for missing evidence that he requested?..

Or maybe he asked for the evidence on the stand at that time? I have seen that happen by people playing the stalling game...not saying that he is..JPs have seen it all and know who is real and who is jerking them around. Both sides get one adjournment only, with cause. After that is goes ahead on the adjourned date.

Maybe see about pushing the date of your final exam back?
