Unless I was there to witness this running of the yelow I can't say who was at fault. It really depends because if approach a yellow and speed up at all it is considered running a red light. However, if you really couldn't stop then it isn't. Well unless he was speeding cause that could be another story. Depending on that it will either be 100% the other cars fault or 50/50 to my understanding. ICBC will find every way to say its 50/50 though lol |
the yellow is a caution light... it is not as good as a green. you're supposed to stop at a yellow with the exception that you can't stop or its too dangerous to stop. In this case it'll still be in your bro's fav as he was going downhill into the light. But here's where the witness gets to state whether the light has been yellow long before your bro got to the intersection or not. |
if the witness said you didnt run a red and it was yellow, then it is not your fault. same thing happened to my friend except my friend was the one turning left and the other guy ran the red. witnesses said the guy ran the red so my friend was lucky or else it would have been his fault (especially b/c the guy lied saying it was not red). what's funnier is my friend works for ICBC :haha: |

i had a similar experience, i was the one making left turn tho, the driver had to hit me but he was running thru a red light, icbc claim examiner told me if i had a witness proved that it was a red light, i was at no fault, but since i had no witness, the other guy won. it happened at marine dr and fraser st, damn at that time there was no red light camera while now there is, and there is one now at that location too! so pissed. so i think the driver going straight is always right as long as it is still yellow. |
