ICBC 50/50 rates question
 
did some research, but can't really find anything about the rates and settlements

Suppose the case is 50/50

what happens to the insurance rates of each party?

say A has a damage of $5000 and B has a damage of $1000. What happens to A and B?

if A chooses to pay ICBC outright, then A will have to pay (5000+1000)/2 = 3000?
OR only pay A's damage, which is $5000.
OR only pay B's damage, which is $1000.

or vice versa?

if A chooses to use their insurance coverage,
what happens to the deductible? $150 each? or still $300each?
what happens to the premium discount? moving up 6 steps? or 3 steps? (assuming CRS = 0)

$150 each for deductible if it's 50/50. It will be an at fault accident for both parties and your insurance will go up. I don't know by how much though. If you are roadstar and have one free accident, this will count towards that free accident. You can of course choose to fix everything yourself. If you are in that situation, the adjuster will be able to tell you.

Also, your rates will not go up if there is no damage claim against you. A huge ford truck demolished the rear of my old Honda and at the end of it, I got a payout against their insurance for the damage and there was nothing against me as you couldn't even tell their truck had hit me. It was a 50/50 ruling as there were no witnesses.

Correct. In this scenario, A would have to repay ICBC half of his repairs, $500, and half of B's repairs, $2500. If A has not repaired their own vehicle, then they would only have to pay for half of B's repairs.

If liability is split, so will the deductibles. So, they would be $150 for both parties, assuming they have a $300 collision deductible to begin with.

According to ICBC.com and this pdf (http://www.icbc.com/cs/Satellite?pag...osts%2Fcrs.pdf), someone who is at 0 will move 6 steps up the scale to a +75% surcharge.

According to ICBC.com and this pdf (http://www.icbc.com/cs/Satellite?pag...osts%2Fcrs.pdf), someone who is at 0 will move 6 steps up the scale to a +75% surcharge.

everything sounds fair until the last point.
so are you saying that for a 50/50, both parties go up 6 steps? (assuming CRS=0)
that doesn't sound fair at all because ICBC is now dinging 2 full surcharges when only 1 surcharge (total) should be penalized.

even if the decision is 25/75, 1/99, the standard moving up still applies?

shouldn't the step ups be shared amongst two parties?

ICBC will only split liabilities 100/0, 50/50, 75/25. In circumstances where there are other liability splits, these are normally assigned by a Judge after the case has gone to court.

Your CRS will be affected only when you have been assessed 26%, or higher, liable for an accident.

In regards to what is fair and what is not, you and a lot of other people may feel that it is not fair and the only thing you can do about it is to write to your MLA. Although IMO, I doubt that will help as the Liberals have had the chance to make changes at ICBC over the past 8 years and from what I can recall, they haven't done a thing.
