Witnesses do not always stop at the scene.....some people also put signs up at the accident location asking for witnesses. Sometimes people phone into ICBC and give their witness statements without any of the drivers knowing.

I've done that before as I was late for an appointment, didn't have time to stop. I noted the time and location and also one of the cars licence plate #'s and descriptions of the cars and then phoned it into dial-a-claim...

you had a police officer. I think the verdict is quite clear....

Of course she's going to say it was you who hit her, and then it becomes a he said vs she said argument. Hopefully the damage can clearly indicate she was at fault.

I got t-boned in an intersection when someone went through a red light. Thank god a police cruiser was already at the light waiting for it to turn green. He gave the guy a ticket for running a red. When I brought this to the attention of the adjuster, he was surprised, since the other party had already given their statement, made no mention of getting a ticket, and said I went through a red. I had to get a copy of the ticket from the cop to prove my story. F'ing bastard that kid was.

thats very nice of you!

just curious tho...did icbc call u later on for any follow ups after?

The_AK 07-10-2009 09:51 PM

heres a question, Say this person "acquires" a witness, but the witnesses story doesn't match up with the damage of the car, can ICBC look the other way and give her 100%?

Not really racist! 07-10-2009 09:54 PM

I depends if she was in front of you then you were probably in her blind spot and it would be 50/50. But if she was behind you and she still merged into you then of course it's her fault.

Wouldnt it technically still be her fault entirely if she merged without checking blind spot? =/ i mean, you cant blame someone for being in your blindspot and also you cant expect the OP to really "stop" in the middle of the road to let some dumb bitch merge right into his lane when theyre driving nearly side by side so suddenly lol Just doesnt really make sense that way.
I mean, unless she's got some really really good story made up about how it's his fault that they merged into each other, considering the way the OP's car was damaged, I dont see how the tables can be turned and have him be at fault for this accident even slightly.

On a side note, i cannot stand ppl not shoulder checking + merging without signals even when there are not that many cars around. argh </3

boibuddha 07-10-2009 11:41 PM

This depends on the location of the damage to your vehicle.

If the damage is mainly to your fender area, there is almost no way of skewing the story in her favour. You win!

If the damage is to your quarter panel, she might BS about you merging over to her lane. She wins...

If the damage is across the whole side of your car, depends on the statements you guys make. Probable 50/50

How could it be 50/50 when he is in her blind spot and she merge in?

No, IF she didnt get a ticket. Its exactly the other way around. She could hv say u merge to her lane if the damage is at ur rear driver's side.
Same goes the other way, if ur damage is at ur front driver's side. That basically show she merge to ur lane and u were in her blind spot, unless she say u hit her on purpose

The_AK 07-11-2009 12:49 AM

Well I spoke with icbc, they examined the car and found some pretty significant damage that shows that she turned into my car. All I have to do now is wait to see what each party's adjusters will say.

J-Chow 07-11-2009 01:55 AM

would you mind posting pics of the damages? it'd be interesting to see where she hit ya. :)

WHEYsted 07-15-2009 09:47 PM

Yes. I am sorry I believe she is mostly at fault.
