The West Vancouver police officer charged with assaulting a newspaper delivery man in January has a received a conditional sentence for his crime.


Const. Griffin Gillan, 25, pleaded guilty to assaulting Phil Khan outside the Hyatt Hotel in downtown Vancouver on January 21.


Gillan's sentence was handed down Wednesday. He received a 21-day conditional sentence to be served in the community.


The Crown had been seeking between four and six months in jail, followed by a year of probation.


Gillan's lawyer, David Butcher, raised other high-profile assault cases in his sentencing argument, noting that former Vancouver Canuck Todd Bertuzzi received a conditional discharge for his on-ice attack on Steve Moore in 2004.


The court had heard Gillan consumed more than 20 drinks the night of the assault, and the officer apologized to Khan while submitting his plea.


Gillan was with two other police officers from other municipalities during the assault. Khan, a 47-year-old native of the Fiji Islands, also says he was the subject of racial slurs during the attack.


Gillan has been suspended from work since February. A disciplinary hearing will be held to determine whether he will be returning to work after his sentence.
So if people like the premier and the police who of all people SHOULD know better can get away with it, why can't you!?

next time you get into a incident such as of the premier and cop:

rationale with the cop, pull the ethics + fair card
if you get a ticket, dispute , go to court, ask the judge for an explanation on how diff the scenarios are ...

tbh I would rather have the 7 figure than to see the cop go to jail if I'm the victim.
do you guys know how expensive keeping a prisoner in jail cost? and all that is coming out of our pocket.

Yea sure might not seem like justice but the victim is going to be basically set for life with all $$$$ he is going to get from suing cop/RCMP civilly.

And we the taxpayer don't have to pay to fatten up another prisoner in jail.

The guy that got beaten up only had minor soft tissue injuries. He claims he has been off work since the incident and needs his pregnant wife to be the sole provider for the family.
He and his family are really milking this incident and are going to sue for big bucks, just like the Moore incident.

In regards to the cop getting a CSO, it doesn't mean he got away scott free. Basically, he was given a house arrest sentence where he has to follow the rules imposed on him. As for the length of the sentence, it was a basic assault charge, not a more severe murder charge or drug trafficking. And because he pleaded guilty to the assault charges, the sentence was propably negotiated ahead of time.

Right now, the most fail is the people on RS and their opinions about our judicial system when they have no clue about how the system works.

Do you even know what that means? He got house arrest, not a conditional discharge.
The judge probably saw how remorseful he was after the incident, how he pleaded guilty to the charge, and how low of a threat he is to society before handing out that ruling.
