McDonald's loses eight-year trademark battle against Malaysian restaurant McCurry

PUTRAJAYA, Malaysia - McDonald's has lost an eight-year trademark battle against the Malaysian restaurant McCurry, which serves Indian food.

The country's highest court ruled Tuesday that the U.S. fast food giant cannot appeal against another court's verdict that allowed McCurry to use the "Mc" prefix.

The ruling by the Federal Court ends all legal avenues for McDonald's to protect its name from what it said was a trademark infringement

A three-member Appeal Court panel had ruled in favour of McCurry Restaurant in April this year. The panel said there was no evidence to show that McCurry was passing off McDonald's business as its own.

McDonald's asked the Federal Court for permission to appeal against that decision but was denied.

Doesn't look like too blatant a copy, I mean you can sorta see the influence, but I don't see why Mcdonald's has a bone to pick with these guys... At least they didn't steal the golden arches like the fake chinese mcdicks

Interesting... they even used the red and yellow. To me, it does seem to be more than a coincidence - that they only named the restaurant McCurry because of the popularity of McDonald's...

It's all about marketing. The Mc alone isn't even that big of a deal.. it's a combination of the colours and the font as well as the prefix that give McDonald's a legitimate case. I'm really surprised about the final result.

Mc or Mac are Irish AND Scottish. The Scotts tend to keep the A and the Irish often shorten it to Mc. So even tho they mean the same thing and are interchangable, Mc will more often than not be Irish and Mac Scottish.

O' is only Irish.
