unpaid commission and bonuses
 
so recently i've been terminated from my job. they made up a bunch of bs reason to fire me. The real reason is they don't want to pay me my commission and bonuses that i'm supposed to be due close to 5k. is there any ways of claiming some if not all of it back? for example i was suppose to be paid my first commission check in december, but they have some bs excuse like you didn't sign ur form so we'll have to give it to you next month when you have the forms signed. now they terminate me before i sign the form and the next commission payout. i ask them what about my december commission now they give me some bs oh you did this and did that so therefore you don't get your commission, really i did nothing that violated company policy but they made some random shit up and say i did. i'm suppose to get my first commission check after i pass my probation which is 2 months ago. and i've yet to receive one and now they fire me they said they are no longer required to give me my commission and fire me RIGHT BEFORE they pay out the bonuses. So technically am i entitled to some of my commission? i have co workers there that can testify i didn't break any policy and such, and really got fired just coz the boss doesn't like me even though i have never met her.

Also, think of ANY... ANY... fucking ANY technicalities under which they can say you weren't due your commission. ANY at all. If you had the forms signed before your pay period ENDED (not before you were supposed to be paid) you're entitled to that money.

If they did it to you, they've probably done it to someone else before. They probably know their game and how to guard against someone calling the labour board. Make sure you are absolutely prepared before going against them.

i was suppose to get some forms to sign when i pass probation, but that's 2 months ago and they have yet to give me those forms to sign. that was their excuse in december when they didn't give me my commission check. i mean i can't really do anything if they purposely don't give me the form to sign?

It is on you to get those froms signed.

Take it up with the labour board and see if you have a chance.

If you post more details (ie which industry), we might be able to help a bit more.

it's with a franchised cellular company. as for the forms i did inquire about them thru emails that's basically the only way to communicate with this company and verbally talked to my managers and i got ignored

Labour Relations Board is for union-related issues. You want the Employment Standards Branch.

Unfortunately, if you were working strictly as a commissioned contractor, they may not apply either. It all depends on what sort of contract or employment arrangement you had with them. Take a browse through the Employment Standards Act and see if you fit any of the categories.

You could also check the Termination of Employment Fact Sheet.

Or just call the ESB and talk to someone about your situation. I would suggest not writing/emailing, unless you get some MASSIVE proofreading done before sending it.

Soundy is correct from my own experience just the threat of calling Labour relations is enough to have them working with you and quickly.




Hope my employees dont see this hehe
