accident , need advice

was heading home, just turned on autin from Gatineau (turn left from Gatineau) heading to government st, Austin turns into Government st past lougheed.

other pickup truck turns right on autin (from lougheed mall), he is heading to lougheed, (he wants to make a left on lougheed - he admitted to icbc).
im in the left lane as i turn, he is changing lanes, so he can get to left turn lane on lougheed intersection.

guess he didn't check blind spot so side swipes me. my front fender/door is damaged. his door is damaged (he is driving a truck)

i checked with icbc , they told me he didn't admit fault, and he said accident happened in middle lane, (which is crap, but admits that he did a lane change.)

i told icbc that he has to cross 3 lanes to get to turn lane, and he is doing lane change and not me.

to add to this, i recorded our conversation on my phone (audio - and can see his face a few times), in the conversation, he did ask me, where did u come from, and he did say, he didn't see me at all.
i was told icbc will try to pin this 50/50
wondering wat my options are.... and anybody knows good lawyers who would handle a case like this.

pretty sure ICBC can tell this is 100% his fault, he's the one doing the lane changing, he should check if its clear before proceeding.... don't kno why you would need a lawyer for this

this plus him doing lane change means u are 99.99% off the hook

yeh, by logic he is at fault cause he has to make lane changes i dont (infact 2 lanes on government merge into 1 (left lane). but dealing with ICBC, u never know what they will pull..
somebody did mention that if it goes to court, the recording is inadmissible as some JP wont let u use it.

Well it's his fault, so there is not much drifting advice I can give you... but as for him, he should have shifted to 3rd, give full gas, turn steering wheel right really fast, back to the left, and drift infront of you with the turn signal, because when you saw him drifting infront of you instead him just trying to cut in, you could have seen him faster and this could have been avoided.

... if he had standard + RWD that is.

it actually makes sense according to ur drawing because he side swiped u while u were in the left lane BEFORE getting into the left turn lane right?

so for HIM he was in the middle lane, but u were in the left lane. (according to ur drawing)

the recording should be admissible in court, seeing as in canada, only one party involved in the conversation needs to be aware that it is being recorded i believe. so as long as you declare it as evidence it should be ok. but def check with a lawyer to be sure.

i would get a lawyer anyway, just in case this guy tries to dick you around. first thing tomorrow morning, call a lawyer.

i can give you the number of one that a lawyer for my employer recommended.

What's all this talk about court and lawyers? A little premature yet. You haven't even heard from ICBC yet.

You turned left into the left-most lane. Assuming you were still in that lane.. (which I think I see that you were, according your drawing) you have nothing to worry about. He should have turned right into the right-most lane. Then he made an unsafe lane change into the middle, then the left lane (and into you).

only gonna be 50/50 if icbc believes that the accident took place in the middle lane. otherwise he should be 100% at fault.

Not really. It's also going to be 50/50 because ICBC is going to try and rape both of you on premiums.

well, my car , the whole right side has damage , starting from right front bumper to ,rear fender,
from what i saw on the other truck, he had damage only to his doors and back, consistant to somebody running into somebody without doing a blind spot check.


i know its a bit premature, but the other guy didn't admit fault, icbc has only our words to go by, and damage to our cars. if they dont do proper investigation, i just dont wanna get stuck with the bill for the other driver's stupid mistake.

this is where it happened, he had just turned right into this intersection, now he has to cross 3 lanes in a short distance to get left turn lane and the white car is where approx he hit me.

as long as the fact that u turned into the lane u were supposed to and he didn't shoulder check and hit you was established, you are in the clear.

He's at fault 100%. If ICBC doesn't agree with you witnesses might help.
