Accident with Quebec plate
 
Hi,

My gf got in a accident last week with a quebec plate car. This is what happened in coles notes
- Front car (A) did a sudden stop
- GF stopped in time
- Quebec plate car (B) hit her back end
- GF hit car (A)

ICBC has given her 0% at fault but wants her to pay deductible because of quebec insurance issues? Is this correct? I wasn't at the appointment today, but the adjuster is saying we don't understand the insurance laws in quebec and this is how its done. GF needs to pay her deductible and if:

- Guy does not have coverage (GF gets her deductible back)
- Guy has coverage (GF needs to go after her deductible FROM the insurance company)

Why does my gf have to pay deductible when she's at 0% fault?

Technically we all pay a deductible even if we're 0% at fault. If the other car is registered in BC then ICBC can collect the deductible directly from the at-fault driver's insurance and refund you instantly.

You've detailed the problem, she has to pay the deductible then go after the Quebec insurer to refund the deductible. The reason is cause the car might actually not be insured if they find out the driver has been out of Quebec too long, and now she has to go after the driver. This is why it is not automatic to refund her deductible and she has to wait to get it back.

This is really a question that needs to be answered by a lawyer unless someone here has been involved in a similar incident and knows how it works.

she's lucky she's not responable for her front end damage and car A's damage. that is normally how it works. as she didn't leave enough space.

Usually, yes, it's a 25% "at fault." However, if the car rear ends you hard enough, they wont say you're at fault for hitting the car ahead of you.

are you really sure? the other guy should be paying and you shouldn't even have to pay the deductable... call them up and ask a different person and see what they say.
