icbc question
 
i have a claim that i never went to take the car to get fixed

but then the car was written off, and i rebuilt it

does ICBC still have to pay out the previous claim(100% other persons fault)

or am i outta luck since the car was written off


i would call, but they are closed today and im curious about this since the damage was 1500$ and other than that damage my car is minty fresh again

How long ago was this? If it's over 2 years, you can just forget about it.

If it's under 2 years, then phone ICBC and see what they say...
(I thought the Claim center line is open 24/7..no?)

What part was supposed to get fixed? I know you had front end damage, but if its the rear bumper then i see no problem getting it fixed...BUT since the car was written off there may be some issues. best bet call them and ask to avoid future troubles

If they write your car off don't they pay you the "insert colour here" book value? Unless this changes when you decide to keep the car...?

wow that's very interesting, as the damage on your door probably had little impact on totalling your car, as well as it may or may not have devalued it.

keep us informed i'm curious to know what it is

but if your car WASN"T totalled, since your rear ending didn't affect the door damage, you'd have 2 years to get it fixed and to take the money.

From my understanding this is what should happen.

-ICBC will pay you for the vehicle according to what fair market value was the day the loss occured, in accordance with your vehicle make, model, trim, mileage, and condition.

-After the car is written off, ICBC will "more than likely" give you the chance to buy it for 1/3rd of the payout you received for the car being written off. (If you were paid 15k for the car as a total loss, you should be able to buy it back for 5k).

-Here is the tricky part, if ICBC calls this a "non-repairable" then there is no point in buying it back (Unless you want to try for an assigned VIN, which in your case I wouldn't recomend). Now if ICBC just puts a "rebuilt" title on it, then you just have to buy the car back from ICBC for the 1/3rd of payout, and get an inspection done to verify the car has been repaired and is roadworthy.

Hopefully that clears things up for you.

ICBC doesn't just look at "book value" on payouts, they will actually see what similar local vehicles are selling for on Autotrader, craigslist, etc. Much of the time, the people I know were fairly happy with their pay outs, it seems to be the one area ICBC doesn't tend to screw it's insured.

my claim was "denied" so they didn't pay anything out.

and the car is rebuilt by a reputable shop, and inspected by one as well and it passed all inspections needed to come back on the road

so now of course i want the body to be straight again, cause every other part of the car is minty fresh, all black and straight wile the rear passenger door is all messed up.

It sounds like this to me,

You purchased a car that was a write off and rebuilt it, the damage you repaired was the damage from accident "A" which was the cause of the write off.

Now there is also additional damage on this car from a prior incident to the accident that cause the "write off", you believe that this previous damage (accident "b") should be covered by ICBC as it was pre-existing to accident "A" and was supposed to be covered by a claim?

ICBC will pay for the repairs providing you have incurred a loss and another party is found to be at fault. If you bought a write off, all claims outstanding on that vehicle are voided. (Provided they occured before status was issued)

EDIT** Just realized you owned the car before accident, your claim was denied because when you bought back the salvage, you bought the car as-is. You might have grounds to argue this but it wont be a simple open and shut case.

The rear door damage was done first, he claimed it but waited to get it fixed...
THEN his car was involved in an accident involving his front bumper, headlights, etc. due to the damage caused it was written off. OP bought car back to fix himself because damage was not that bad. So now the dilemma is will ICBC fix the damage to the rear door that was done before the car was written off?

That is my situation but I never bought the car back as icbc never bought it from me but rather denied the write off claim

I'll be calling icbc at lunch

Did you get paid out for the vehicle? I don't see how they could "write it off" unless they paid for it.

no, they denied my claim(third time i have said this...)
told me to fuck off, and put a salvage title on my car.
