Latanya Evans, 49, was arrested on a charge of drunken driving after her daughter handed a bank teller a note saying her mother was drunk and she did not want to ride in the car with her, police said.
"The girl was very smart and did the right thing," Southfield Police Lt. Nick Loussia told The Detroit News. "She tried to get her mother help, and she refused to get back in the car with her mom because she had been drinking."

Evans was arrested a short distance from the bank, at which time officers determined she was driving under the influence and on a suspended license, Loussia said.

"Officers said she was having trouble getting out of the car and her speech was slurred, her eyes glassy and she smelled of alcohol," Loussia said. "She subsequently failed field sobriety tests, including a preliminary breath test, and was placed under arrest."

According to The Detroit News, Evans has had several prior run-ins with the law and has had her license suspended five times, twice for drunken driving. The newspaper also said she was convicted of child endangerment in 2002.

Evans appeared in court Saturday on charges of driving under the influence, third offense, and driving on a suspended license. She was released on $2,500 bond. The state Department of Human Services is now reviewing the case for possible action.

"This was a dangerous situation and had the potential for people to be injured. It was a good outcome to a bad event," Loussia told Detroit News.

Southfield police did not immediately return calls from comment from AOL News today.

I guess the daughters education is working.

On another note. Is failing the breath test enough evidence for getting a DUI?

ie. if a cop pulls you over and you blow over 0.08 or 0.05, but you pass all the field tests and other tests can you still get fined/towed ?

i'm just worried about the girl now

hopefully the mother will lose custody of her, because i could see an irresponsible person like her mom physically harm her for ratting her out

But on a serious note, i hope the mother doesn't harm the girl, in addition, if the mother had previous offenses she better get her shit together! You know you're a fuck up when your own kid can understand the dangers of DUI and you continue to not fix it.

wow, smart girl; brave too! standing against your mother's actions at the age of 9 is impressive. *hopefully* this is a wake up call for the mother. if not, she should totally lose custody of her daughter.

Two different charges...blowing over .08 is one charge, care & control/driving while impaired is another. I don't drink and if I had a couple of beers that would make me likely not legally impaired ( over .05/08) but I would be physically impaired and liable for charges of impairment. There are people who drink a lot and who can mask some of the symptoms of impairment by alcohol at a level of .05/.08 but they would be charged for over .05/.08. Impairment does not have to be falling down drunk and the law says any level of impairment IS impairment

With the mother's history, I sure the girl was fully aware of the situation. Sad, sad way to learn though.
