IIRC unfortunately ICBC deals with this as a single car collision, and IME will likely be at fault. Basically even though it might not technically be his fault, his car is the only one involved, and therefore the blame lands on him. actually icbc does not always think like this. the trick it proving that the decision made by op was better then the alternative.ie hitting the other car. in this case with the video it should be very easy to pin the claim on the white car. the accident was caused by the white car regardless of the fact the white car sustained no damage. icbc will look at the footage and hopefully decide that op made the better judgment call to wreck his car into the tree instead of colliding with the white car and thus having the much greater chance of icbc having to pay out injury claims, op can probably expect a fault breakdown of 75/25 where 25% will be deemed op's fault. probably based on "you could have been driving more cautiously" but being deemed 25% will not affect premiums and will not affect the insurance payout for the vehicle repairs.

my wife was in a very similar accident but with no footage. she hit a parked car instead of a head on with another vehicle. because of the lack of footage it took a bit of wrangling with icbc but in the end the claim ended as i described above and the driver/vehicle that caused the accident but received no damage was charged with the claim for both my wifes car and the parked car.

if you don't feel confident dealing with icbc on your own. get a lawyer.

^ Part of the problem of those near misses is the height difference between both vehicles. He *may* have shoulder checked but not seen you. Not much you can do in that case except what you already did.
