Question regarding shifts and hours (Overtime)

So, I have 5 shifts this week and my employer called me, telling me that I have work today. However, that would mean that I'm working 6 days this week. He told me that as a part-time employee, you can work 6 days a week. So, I'm wondering right now, if it's BS or not. The company is Costco, if that helps.

Would that mean, no overtime pay? :suspicious:

Thanks.

I think its based on the hours you work

cho 10-26-2011 03:20 PM

If they ask you to work a 6th, you should be entitled to ot, if you are willing to work a 6th and want to be scheduled it wont be ot

6th shift or anything after 40 hours in a week is ot

Does Costco have a union? Union rules may be siff

Government of B.C., Ministry of Labour, Employment Standards Branch, Hours of Work and Overtime Factsheet

Quote:

Hours free from work
An employee must have at least 32 hours in a row free from work each week. If an employee works during this period, he or she must be paid time-and-a-half for all hours worked. This means that an employee who works seven days in a week must be paid time-and-a-half for one of the days, even if the employee worked less than 40 hours in total. The employer may pay time-and-a-half on the day with the least number of hours.
Quote:

Overtime
A week runs from Sunday through Saturday for the purposes of calculating overtime.

Both the number of hours worked in a day and the number of hours worked in a week must be looked at when calculating overtime.

Daily overtime
After working eight hours in a day an employee must be paid time-and-a-half for the next four hours worked, and double time for all hours worked in excess of 12 hours in a day. This applies even if the employee works less than 40 hours in a week.

Weekly overtime
An employee who works more than 40 hours in a week must be paid time-and-a-half after 40 hours. This applies even if the employee never works more than eight hours in a day.

Only the first eight hours worked each day are used to calculate total hours for weekly overtime.
This is all BC Labour Code, and your employer must abide by it, regardless of what they claim your "part/full time" status to be.

So wait.. basically my employer is lying when he tells me that the week ends on a sunday?
It's retarded, since I have 6 shifts this week, totaling up to 30.25 hours.. :concentrate:

and no, it's not an union unfortunately

Hm...never knew about the 32 hours off in a row rule

XplicitLuder 10-30-2011 03:02 PM

i work mon-thursday, friday off, saturday back to work, sunday off. Since i dont have "32hrs free in a row" does that mean saturday is OT ?

mb_ 10-30-2011 08:06 PM

I think the first hour of the 32 starts when you get off work

pretty sure you have 32hrs free in a roll say if you get off thursday at 9pm and the next time u work say saturday and the earliest u work is like 6am.. from thursday 9pm to saturday 6am that's at least 33hrs right there and i doubt you work those kinds of shift.. the only way i can see ppl don't have 33hrs free in a row is if u somehow work til 12am. get a day off and then the next day works at 6am. it's all worked out :) employer ain't dumb enough to break those rules.. they are professionals when it comes to trying to find ways to pay u as little as they can :)

Since we're talking about shifts, gonna hijack the thread a bit (sorry op!)

How many hrs are there suppose to be in between shifts? My manager has been scheduling me to work until 8/9pm and 4am the next day. Mom says there's suppose to be 8hrs in between shifts or else it'll be considered OT. Couldn't find anything on BC Labour code

RHMadness 11-01-2011 08:26 AM

Hi guys,

I work in Labour relations and unfortunately, employers that are not unionized DO NOT have to follow the labour code.. They are only bound by the Employment standards Act.. The labour code is for unionized employers above the collective agreement. Thats why when you call the labour board of BC and you are not unionized, they cant help you.
I believe the time between shifts is 8 hours in BC..

Link was posted above. Are you working till 8? or till 9? I don't think it's considered OT, but you can request to get more time off between.

mb_ 11-01-2011 10:07 AM

Thanks gars. My schedules not quite fixed but sometimes I work till 8, sometimes till 9.

It's only once a week though so it's no big deal but there's those nights that I have trouble sleeping.

k3mps 11-05-2011 05:22 PM

bump,
so as of now, I work 6 days a week and have been doing so for almost a month now.
I'm not getting overtime pay, but I'm also not given a day off a week.
my other co-workers only work 5 days a week, but I work 6, and I get shut down every time I ask for a day off.
what should I do?

mb_ 11-05-2011 06:25 PM

What company do you work for?

k3mps 11-06-2011 03:49 PM

dealership
