Accident questions - Rear ended someone.

First time getting into a accident basically I got off work was super super tired and the roads were very wet and just before a red light the car in front of me slammed on his brakes so i slammed on my brakes but because of the stupid rain my car slid and i rear ended him. His car has a small scratch my car has a scratch on the bumper and my hood is a little bent, my emblem got torn off and my license plate is bent. Everyone was ok even though his son was in his back seat and didnt have his seat belt on ( you can kinda see him in the video). I know im at fault but If the guy decides to make a claim.

Will i get anything out of ICBC because of road conditions?



I trimmed the video but i have the original video that clearly shows i have plenty of room and that my car slid.

they dont really care, sure you left a good amount of room but it wasnt enough to prevent the accident so therefore its your fault

i think the only time you're not 100% at fault is if all his brake lights were broken

If he does claim it you can always pay icbc out of your own pocket to fix his car so your insurance won't go up.

You should be the given the opportunity to pay for the damage and not be bumped up on the CRS (assuming the guy doesn't claim for personal injury). I'm pretty sure that this option would be much better for you.

Unfortunately you will be at 100% fault.

Did he admit to his son not wearing his seat belt? Wonder if that will affect ICBC's ruling...

and in terms of fault, you are completely at fault, regardless of weather conditions you should have left adequate amount of room in order to stop safely...

and as mentioned above you can pay out the damage so your premiums don't increase but not if the other party claims personal injury(depending on severity you may still be able to pay, but it might not be worth it because physio adds up quick)

lol reminds me like the same type of accident when i rear ended the person infront of me. you wont get anything, luckily no huge damage :P i suggest you pay out of your own pocket for this, or else you'll be hella screwed in the long run. Doesn't seem bad enough for an injury claim from the other person..but you never know

DO NOT settle this privately.. go through ICBC and pay for damages out of your pocket if you can afford it

Yeah Im definitely paying out of my own pocket considering the insurance is under my dads name and I really don't want to screw his insurance.

as for injury claim before we even looked at the damages I asked if he was ok and if is son was ok and he said yes. judging by the damages and the way he jumped out of his car like a wild hyena I'm guessing theirs no injuries.


I would like to take this time and thank everyone of you for your opinions and support.

I had some idiot stop at a green light on kgb and I rear ended him and 100% at fault. If the repairs are going to be minimal then like everyone else I suggest payback icbc.
My front bumper would cost 1400 to repair and I assume his will be the same, if not more, so I have decided that I'll just pay the extra rate

fortunately though, this accident happened in october and when I went to renew insurance in jan the rates hadn't been bumped up. Guy is claiming injury, of course, so I figure since I told them I want the option to pay that rates won't go up until the renewal after they decide if claim is valid or not. Which hopefully takes at least another year so as to reap another year of discount, lol

Hey man, honestly go thru insurance. Yea you can pay for his car to get fixed and what not but after you give him cash he might go and do the insurance anyways. Thus double screwed, don't think the drive wont. (Not saying he will but you never know, and you can never be too careful) Next thing you know he might say he has injuries for his son even...

you never know man just do the right thing, last thing I want is a thread "I got fuuuuu'ed by a bmw driver"

Go through ICBC.

He has a set period of time to claim injuries with ICBC. If he claims injuries and ICBC settles, he CANNOT go after you in a civil suit because you were covered by ICBC.

If you don't go through ICBC who knows what a judge will give him in a civil suit ...

Honestly its all up to my dad since the insurance is under his name....if he decides to just pay the bmw driver for the damages then ill pay him. If he decides to go thru insurance then ill pay him however much increase he has to pay yearly

I agree with what is already posted, stick with ICBC. Too many people get screwed trying to avoid ICBC and even minor damage on a BMW bumper will cost $1000+ to repair so it's not worth the hassle.

Yeah no BMW driver will do private. Just ICBC it and pay out of your pocket to avoid the major price hikes. If you also insure your own car, then your dad might be off the hook as they will ding your rates and leave his alone! Out of curiosity, did your car not have ABS? It looked like a lock up
