You really think morals are high right now?
How many cases do you hear on a weekly basis about groups of people beating the snot outta someone and bystanders just taking photos to post up on the web? Or how many cases do you hear of girls getting raped and gang banged while other stand around doing nothing or worst yet again taking pictures to spread around and laugh about it? How many cases do you hear of people mixing mad amounts of drugs, booze etc dying over it and then society accepts it like its the norm and poor guy bla bla bla. I can go on but whats the point as long as people think fats the new thin, society and morals are gone or quickly going.
Its Rome all over..........
Disclaimer, the fat thin thing is a metaphor.

You should've just taken off your clothes, shipped out your evo with you inside, jump out of your trunk, beat him up with a crow bar and then drove home and reported to RS.
That would have been more epic

you fraud somebody you get charged with fraud
you attempt to fraud somebody you get no charge

SO WHATS TO STOP PEOPLE FROM TRYING!!
Morals are dwindling ever faster within society and since most dont fear god any longer the law and how its enforced are whats left to protect us. They fail over and over and over again

I get your frustration, but to have a legal charge of "attempted fraud" you'd actually have to read his mind.

No offense but you couldn't possibly be more wrong in that statement.

As much as stuff sucks, we are basically at the absolute pinnacle of humanity right now. If you look at history, things were much, much worse. Even 100 years ago. Hell, even 50 years ago

So you might waste his time too? Good job. It's unlikely that the police are going to be able to do anything serious anyways.

Mark

you were saying?

As I understand it, for a crime of intent you need the accused to have intended to commit the criminal act AND have done something that "goes beyond mere preparation" towards that act.

You can infer intent from the evidence.

Gridlock 07-25-2013 10:17 PM

Well this is my point.

It's more difficult to prove intent on fraud if no fraud occurred than it is as attempted murder or some of the other things that Phil mentioned(attempted robbery, rape and so on). Either you are fraudulent or you are talking about it. So the crime is lying. Well, in the eyes of the law, THAT would open up a can of worms. Attempted murder is usually you sucking at actual murder-ie, the guy lived. Attempted robbery-same.

But there isn't really a "kinda" fraud. You either succeed-charged with fraud, or it was a business transaction that didn't work out.

This kid..we ALL know he was gonna take the car. But prove it. Not so easy. Everything else can really be a bad deal, or lying on the internet or 1000 other things.

they can be charged with conspiracy

Quote:

Conspiracy 465.
(1) Except where otherwise expressly
provided by law, the following provisions apply
in respect of conspiracy:

(c) every one who conspires with any one to
commit an indictable offence not provided
for in paragraph (a) or (b) is guilty of an indictable
offence and liable to the same punishment
as that to which an accused who is
guilty of that offence would, on conviction,
be liable; and
(d) every one who conspires with any one to
commit an offence punishable on summary
conviction is guilty of an offence punishable
on summary conviction.

What I've been noticing these days is people who only ask you for your phone number + name. If you give them that they start spamming the number. beware

Just cause you have evidence doesn't necessarily mean you'll win in court. Prosecutors or the defender's lawyer can use those evidence against you, or simply make it so it's not as strong to prove someone guilty.

Witnesses on the other hand is much stronger. If the dealership's salesman and the guy at Canada Fleet Services were willing to testify, he would have a better case.

Then why arent cops proceeding with that?

StylinRed 07-27-2013 01:43 AM

they probably felt there wasn't sufficient evidence for it or didn't think it was worth investigating to see if there was enough evidence you usually only see those charges on large $ cases/fraud rings and in combination with actual fraud charges
