Help with ICBC Claim
 
Just curious if there was any law students in here...

I got in a pretty bad accident when I was 18 (im now 26) and I claimed injuries for back injuries. I've since been fine and almost back to normal, just my back is a little weaker than it was before. As of today, I got sideswiped and tossed my truck off the road into a golf-course. Ya... seniors for ya. Truck is a write off, and my back is completely tensed up and spazzeming out. Since I have already claimed a back injury in the past, can I claim this again? I was checked out and I've got soft tissue damage. I'm not in it for a money-grab; but I'd like physio etc covered to get this shit right and get me back to work.

im no law student..but if you claimed it before and now it hurts against due to some idiot sideswiping you, i'd claim it a billion times if i had too. the pains are ocurring due to this current accident, so ya

Not a law student, but I can paraphrase my case manager in saying, a preexisting injury is not a barrier to compensation should a new injury develop. Call ICBC, they should be able to confirm for you.

If an injury is caused or contributed to by an accident, generally injured parties can claim for new injuries or re-aggravation of old injuries.

definitely claim your injuries. Worse case is you will have to find a good lawyer to represent you to deal with ICBC. If it is really bad, you can opt to sue the other driver for your injuries.

I've got a lawyer, their offer wont even cover medical bills for a year.

Lol what kind of shitty lawyer do you have.

If the accident is not your fault, then you should be eligible for part 7 benefits.

They will pay for all medical bills, physio, recovery, wage etc until you are 100% back to normal. YES this includes injuries from previous accidents.

Why would you get an offer so early.
