Witness Wanted: Parking Lot Accident Hey guys, wanted to help out my dad by looking for some witnesses. Time: 4:15pm-4:30pm, June25, 2013 Where: Canadian Tire parking lot, Hawkins street, Port Coquitlam Cars: Mazda MPV, Honda CRV From what my dad told me, he was pulling out of his stall in his MPV and while he was coming to a stop, the CRV started to back out of his stall at a fast pace. When he came to a stop, the CRV continued to back up, so he layed on the horn and tried to put it in drive, but couldn't get away fast enough and got hit. He asked 2 people to be witnesses, however one person claimed that they only turned around when they heard the crash, so he didn't want to be a witness. The second person said he heard the honking, but didn't turn around until the crash happened so he thought he couldn't be of much help either and didn't offer to leave his info. Damage isn't too bad, just a mid-sized dent on the tailgate. Just sucks that the guy who hit my dads van just got out, looked at the damage, left his info and said "just claim it" and left. Btw since you guys are the pros, how do you think this will end up with ICBC? I'm guessing 50/50.. even without witnesses, it's kind of hard to prove who was at fault here. Guess we'll have to wait for the other guys story and see what he says. Thanks RS! |
Well it would had helped if your dad had taken pictures of the car's position before they were moved. Time to invest in a dashcam. In situations like this even a cheapest POS should be sufficient. Draw a diagram when you present to ICBC, you might want to make it obvious that it is impossible for the other car to be pulling into the parking spot when your dad is moving. So hopefully by deduction they can figure that the other car was pulling out. |

Most dashcam has a g sensor.. so it will show the location of your dad's car (moving out of the stall) stopped and the X axis of the accelerometer spike when your dad is hit when he is not moving. Quote:

I have been in a similar accident before, and the ruling of this according to the motor vehicle act of bc will be that the vehicle who was moving in the reverse direction will be 100% at fault for the accident. However, this is only if your dad is able to prove that he was stationary and the other vehicle backed up into him. Unless the other party will admit fault for backing up into ur dad the chances are that they may just rule this as a 50/50. |
If indeed he was stopped when the other car hit him, then a dashcam would definitely help in this situation. Can't you claim this as a hit-and-run since the other driver just left? Unless if they exchanged info before leaving? |
Doesnt matter if your dash cam facing at the direction of the other car. If the dash camera capture stand still images like a second or two before the hit then once the other party hits your dad's car, the dash camera should capture the sound and also the video wouldn't be stand still as now the car will move/vibrate/shock a bit. Will also capture the honk sound =) |

Happened to me in Ikea in Richmond. Driver backed up rthe wrong way (when they still had all those one way lanes) driver admitted to backing into me yet ICBC still said 50/50 and wouldn't fix my damage. Good luck thoPosted via RS Mind Control |

^In that case, I think ICBC will just say 50/50 since there's not enough evidence. However, good luck, and hopefully you can find a witness! |
