But what IF on the night of the event, the OP walked up to the Fraudster after being hit; and pulls a bluff by saying, "Hey buddy, I've got a dash-cam installed, you wanna explain what just happened?"

By pulling a bluff, the Fraudster might either demand to see the dashcam, OR pony-up and pay for the damages. Correct me if I'm wrong, but the bluff would put the Fraudster on the spot and put his mind in a frenzy...

Anyhow, best luck to you OP!

this is what i was thinking, you can tell them that icbc contacted you and asked you to bring forward evidence so you are bringing in your dash camera, ask them why they lied and give them the chance to make right before they are charged with fraud and found 100% guilty of the accident... nothing to lose in a bluff.

in my case I actually do have a dash camera.. but it dosnt hurt to try

Unfortunately, you're pretty much out of luck.

Happened to me years ago.. Guy in a rusty pickup truck with a standard transmission let it roll back at a stop light into my SC400. About $600 in damages requiring a bumper respray.

He told ICBC I rear-ended him. Have to give credit to ICBC for this one, but they sent an investigator to the intersection and determined that it was on an incline, which gave credibility to my side. Ultimately, ICBC did not find him at fault, but they decided to goodwill my repair and not find me at fault either. This happened over 10 years ago, I don't think ICBC would ever do something like this for a customer today.

i don't believe icbc will just let someone go that easily....they have their lawyers doing the leg work on that one...

JesseBlue 07-26-2013 08:23 PM

i know this might get expensive but ever thought about getting legal help? especially if you feel that you're innocent...

Gtrr33 07-26-2013 09:04 PM

fuck i hate this!!! this also happened to me.

report him regardless!!!!, if the other party is known to scam ICBC they might give you the benefit of the doubt, if not its another negative report under his belt.

godwin 07-26-2013 09:10 PM

That's waste of time and money because the discernment of who's at fault is under ICBC's internal process. Lawyers only become useful if you can actually prove laws are broken.

Currently we only have OP's side of the story.

doritos 10-08-2013 12:26 AM

post some flyers asking for witness to the incident that day. I'll happen to drive by, since I live around there, and see your flyer, and give you a call. BAM done. Can I buy your bumper btw =D

604STIG 10-08-2013 09:44 AM

On a side note. I never understand why people would decide to use a size 11 font or place their witness signs on the shoulder of a highway. Best LOL is when they write it in Chinese only (seen a few in Richmond).

seriously...if you can afford a damn car.... then you can afford a damn dashcam.... how many threads is it gonna take to convince you? and everyone else who doesn't have one... in this day and age, with the idiots out there... why not protect your 'investment'?

it's just a matter of time before dash cams come optional or even equipped on new cars... DO IT NOW!

Matlock 10-08-2013 02:08 PM

I will need to get a dash cam too just to prevent me from murdering any scammer if this ever does happen to me. I know I would murder them regardless of the consequences if they were clearly trying to scam.

Domani 10-08-2013 08:29 PM

sorry to hear that situation OP. Karma will get him sooner or later.

really thinking about a dash cam now.... what's are some really good ones which RS recommend?

spoonek4 10-08-2013 08:58 PM

Good luck OP!!!

It's easy for ICBC to point finger at you & say....

"WHY U FOLLOW SO CLOSE!?!?!?!?"

I believe in karma like almost everybody else. Get a good quality dash cam just in case for next time.

you mean "liability". Cars are not investments

E-SPEC 10-09-2013 09:30 AM

wOW! What a MOTHERFUCKER! I seriously think i would either end up in a fist fight w/ that asshole or an assault charge. i really hope you prevail on this!

Nvasion 10-09-2013 09:54 AM

this happend to me a few years back on knight and kingsway at a red light. truck decides to throw it into reverse and drive on my hood.

luckily he owned up to it and paid for everything.

snails 10-09-2013 10:10 AM

i don't get how people don't invest in a dash cam... icbc is not something to gamble with.. i have been on the short end of the stick and it wasn't a good time.. ended up costing me alot of money.. week later i got a dash cam.. driving actually feels safer, not that it will prevent accidents.. it prevents icbc from fisting you.. and thats usually worse than the accident!

agreed. i got my dashvue400 for i think 280 installed and if anyone ever backed up into my car and the camera caught it then ill already have made up the money for the camera

ricecookerboi 10-09-2013 01:51 PM

OP sorry about what happen man, I hope Karma kicks that guy in the butt.

I know this is a stupid question but if he backed up in to you and somehow at the end its your fault, it just doesn't make sense, say a guy who drives a crapbox car and decides mhmm I want a new car won't he just back up in to someones car and boom get a new car ? or get money out of it ? yeah jerkoff way to do it but yeah. Just something that crossed my mind .....

He doesn't get a new car, ICBC will see if the repairs cost more than his car, and choose the cheaper option. A "bump" will result in minor scuffs, and they won't give him a new car, but pay ~500 to repair the bumper. If the crapbox is worth less than 500, they'l just give him cash. But good luck trying to find a decent car for $500.

That being said, assholes that do this and don't take responsibilities are scumbags.
