UPOV 78 never gave farmers the right to sell the seed. In fact, it's never been legal. Also, 78 also doesn't actually allow farmers to reseed their own growth. UPOV 91 is written up in a manner that gives legal rights to farmers to replant their own seeds from their own selected production runs. Source: I grew up, and currently live, in farm country. |
