ICBC Write-off Payout question
 
About 2 months ago I got into anccident with my Audi, the icbc adjusters decided they'd allow up to $7700 in work to be done to my car by the body shop,body shop gives them quotes $8200 in damage, and ICBC says they're writing off my car, I say fine, let me know when to pick up my cheque. Friday I get a call saying they're only going to give me $5000 for my car, minus the $500 deductible. Am I crazy, but shouldn't they be giving me the value of my car? which is closer to $9500

I'm not sure what I should be doing at this point, if I should fight it, and if I should how I would go about it?

Fight it and don't sign anything until you get a number that's acceptable to you. Look at prices in the auto trader that are similar to yours and bring them in.

They like to lowball you at first since a lot of people will just take the offer and get it over with.

Try to find ads that are similar model/mileage bring them in to ICBC to show them what the average price for the vehicle should be.

i have a question regarding this dont sign anything. When my car was written off, i had to sign something before they could even proceed, and nothing else (at least from what i remember) so how does one go about not signing anything without them giving you your fair price, if they cant even give you a price unless you sign so they can proceed

Did you read the papers you had to sign? The one ppl generally refer to are papers that hand over ownership of the car to ICBC. When I had a vehicle written off, I only had 1 paper to sign for the whole process and it was the one that gives up ownership. I signed it at the very end of the process.

The only thing they asked me to sign was the Salvage Release when they wrote off my car.

This is when I asked if I HAD to sign it, and the adjuster said no. I think signing it when you pickup the cheque instead of before really helped me get a fair value.

Get the price you are satisfy with (most likely the blue book value). Otherwise demand that they repair your vehicle or else take them to court because refusing to repair your vehicle is considered fraud.

Sorry to steal your thread but my 1995 325i convertible was just totalled and I still haven't signed yet.
They offered me $4200 before deductible. I insisted that it is worth more and sent my adjuster a couple of coupes that are older (i.e. 92/93) and priced higher on Craigslist. I assumed that a convertible would be worth more and a later year would also be the same case.
However she said she wants to be comparing apples to apples and tells me to find 1995 convertibles only.
Do I have a case here?

Potentially, but you're always best comparing like model years and trim levels. Unless you can make a case that if a '93 model is worth $A and a '97 model is worth $C, so your '95 should theoretically be worth $B. However, that's a crapshoot and there always a ton of variables. You're best off looking for the same year.

That said, unless your car had exceptionally low mileage and/or you kept immaculate records of all the maintenance, their offer seems relatively decent.

you could try comparing black book pricing on 2003 and up 3 series to prove that verts are/arent worth more?
