Question Regarding False Claim of Car Accident
 
Hello Revscene Users,

I have been a lurker on this forum for some time now, but have made few posts in the past, so a hasty hello to all!

Today I was involved in a rather peculiar situation in where I was quite dumbfounded and confused as to what to do. I had picked up my friend to head over to a store earlier around 3:00 PM today, and upon arriving at that store, I had found a parking spot and backed in. I had gotten out, and saw that I had parked too close, but did not touch the car directly behind me. "Meh" I thought, no biggie, I'll just correct the parking job so it is done properly. Then out of the blue this lady comes out and accuses me of backing into this car that was behind me, and is telling me to leave a number or she'll take a picture of my vehicle's plate and will report me to the police. She said that there is scratches on my bumper to prove I'm guilty (they were previously there and not 'fresh', and it was also streaked with dirt). I was honestly confused at this lady's accusation. So as soon as this lady left, a gentlemen in an adjacent parking spot was smoking a cigarette, and told me to leave a fake PH (I did not, as that would be admitting some sort of guilt). So after this lady left, me and my friend left without doing anything. I am worried now that I will be reported to the police and charged with some sort of infraction and /or crime that I did not commit, as falsely accused by this lady. I am even an N driver and am worrying that this would affect my driving record. What should I do? I am very worried.

It also might be helpful to add that I have a dash camera, and upon reviewing it shows my innocence and no apparent "thud".

I'm no expert with ICBC law but assuming your story is 100% accurate then I would do nothing. If I was in the same situation and I know 100% for certain I did not back into a car then I will leave it at that. Just because some random person says otherwise and threatens to report me doesn't mean I have to respond, As bad as ICBC can be I would have faith that any evidence they attempt to collect would prove otherwise because well I didn't do shit. Maybe I'm trusting trusting the system too much though lol dunno.

If the cars were in contact, the damage has to match up with the other car, paint likely would get transferred from one place to another. If ICBC does knock on your door but can prove neither, then they can't do anything.

but the other car wasnt damaged.... which means the other car wouldnt need to file a claim.

I've had someone back into me at a light and successfully make a claim saying I rear ended him. I probably wouldn't do anything but I wouldn't trust ICBC to do the right thing either.

Even IF the lady does report you, nothing will happen due to multiple reasons..

1)She has insufficient proof to support her accusation, its a matter of he said she said game..
2)the owner of the car would have to file a claim through ICBC to initiate the investigation process
3)and IF the owner of the other car makes a claim, the damages would have to match up

Nothing to worry about man.
If the lady goes to the police or ICBC, they will have to match-up the evidence to make you pay for damages. If you truly did not hit her car, you don't have to worry about it.
The only hassle is that you have to spend some time to bring your car into ICBC for the adjuster to look at the (non) damages.

Hopefully you took some pictures before leaving...

I think the lady is trying to scam you for some cash. Most people will just pay some cash to shut the other person up if they actually hit the car.

Didn't expect this response, thanks!

Yesterday I was panicking because it was the first time that anything of the sort occurred to me, and I was puzzled as to what I should do. I feel more confident now that shit isn't going to happen, and if it does I'll know how to go forward with it and will probably make another forum post here detailing it.
