i think the issue here is that he has the authority to give the orders. not the other way around.
you can't force people to be polite. you just have to deal with it.

I agree this guy was asking for trouble. And the guard delivered.
Both sides could have done things differently. If he just shut off his motor, nothing would have happened, and if the guard just said please, nothing would have happened.
Instead, a guy gets a face full of mace... for what?
A little diplomacy goes a long way.
The guard did not need to say please. It is not part of the job description. It is, however, a part of crossing the boarder that you abide by what the boarder guards tell you to do.
Simple as that. The driver was clearly at fault. Anyone that says anything different is an IDIOT.

No one is arguing that. But as soon as the driver said please, the ball was in the agent's court.
He decided to pull the mace a bit too early in my opinion, and from the sounds of this article, didn't explore less dramatic avenues to solve the problem.
Or perhaps he did, and we aren't getting the whole story.
I think it could have been resolved without the mace and gang tackle. But that's just me.
The guard told the guy to shut off the car or he'd get pepper sprayed, the guy responded by telling the guard to say please, and not shutting off the car. What grey area can you possibly see in this?

This is a case of both sides failing to budge on their principals.
Please tell us you are partially retarded. That is the only explaination to your post.
That US border guard is in a position of authority. There is no failing to budge on the border guard's principle. When they ask you to jump, the only thing you can say is "how high?"
If you get pulled over by the police, are you going to ask the police officer to say please when they ask you for your drivers liscence and registration?

which leads me to a story
i was crossing the border and was worried because i've never done it without my parents, i was with 3 friends. The border guard asked me how we knew each other and what our plans were. I told him we were all highschool friends and we plan to take the summer off and go to university in the fall.
He had meant for the day.
lol the guard laughed pretty hard after. Only time i ever saw a border guard lose composure.
What I am saying is that once you look past that, to what could have topped this in the first place, its just a matter of principal. The guy didn't want to be pushed around by the guard who refused to say please - which would have fixed this problem once it started.
Sure he can do that. But why would the border guards want to look soft? Why would they want to give the implication that their authority is questionable? Do you think they're pushovers?
Refusing to shut off the engine upon request is already grounds for suspicious behavior. For all the border guard's guess, Mr. Fortunato could be one of those stupid enough to try and make a run for it for reasons of his own :rolleyes:

Perhaps... but the border guard could still have handled it without going straight for a physical response. Obviously, this must have escalated extremely quickly... but if border guard was just a little bit more restrained, he could have calmly explained to the man that he has no obligation to say please, and if he does not cooperate upon the next request, he will be physically removed from the vehicle, etc... and if that was explained clearly and calmly and the guy still doesn't do as told, then the actions would be perfectly justified.

Anyways, I get your point. He could've taken the next intermediary option and be polite. But by then, the border guard would be his bitch.
Luckily the guy only got the spray. I actually woudln't have minded the tazer in this situation. Either jolt his heart for darwinism, or jolt some braincells into revival for human progress. I'm all for it.
Oh and edit:
If he ever wanted to stop the Border Guards tazing him, he'd have to say "Please"

they should charge him with mischief or whatever the US equivalent is, and then flag him so he gets annnoyed everytime he comes through
