: Is this illegal or breaching privacy issues?

If Person A works for companyABC (which is a NOT FOR PROFIT ORGANIZATION) and Person A is applying for a job at XYZ company.

Is it a breach of privacy if Person A shows financial statements he created for CompanyABC to Person B at XYZ company?


Key point to keep in mind is that CompanyABC is a NOT FOR PROFIT org, so isn't everything suppose to be transparent?

I don't know about illegal, but I do "know" about ethical (unethical in my book). I wouldn't do it.

If XYZ wants to see what you did at ABC, couldn't you scramble the numbers of the real ABC data?

if you work for ABC, isn't anything you create for ABC property of ABC? Especially if it reveals private information of ABC.

If you just want proof of concept, there are many ways to do it without revealing ABC's private/confidential information. (i.e. blank out certain information)

I wouldn't even consider working for XYZ if they asked for stuff like that. If ABC ever finds out, you are fucked big time doesnt matter if ABC is a NFP organization.

If they want to know what you can do, that's what your resume and references are for... Why would you reveal your current company information to a third party? Those are sensitive information. Revealing it = ground for dismissal.

you better black everything out on those statements that you show... and it makes no sense to show XYZ you could do that... if they required proof... make a mock-up of a fictional company...

To put it in simple terms. Yes it is illegal, ABC can sue your ass if they choose. How do I know? because I work for a NPO too.

he's talking about companies. i was wondering what if say A is from a student club or something, presenting it to a company for hire? i am assuming that would be the same case? or totally different?

Acutally my ex_GF went though something similar.

she was a head hunter. and was about to get a VP of finance a job with company A, the guy use to work for Company B, but before the guy would accept the job, He wanted to see the financial statements of the COmpany A, (only thing is the company was a direct competitor)

The company right out refused. You cannot show financial statements because you sign a privacy agreement when starting the job in any company (non profit or not). If they find out. u can be in deep shit.

SHE lost 30k in commission, out of which 15k would have gone in her pocket.



Main thing to remember, even though it was created by you, it was done when you were on the paycheck of company A, thus property of company A

(similar to Xerox and Novell lawsuit,,, some people would know this?)

would the rights of the program that was written belong to me or the company?

Yes he can.

It's a breach of trust. even if you didn't sign any confidentiality form, Anything created for a purpose for a specific company/student club or anything. It legally is the property and intellect of that particular company.

Example, if you create a item with X company, but you didn't sign any confidentiality agreement, but company Y wants to see it before he hires you. You can be sued for theft. As the item was created on their property/grounds/equipment and using their technology and information to build it.

Even say you are a professor that created X at a university, the item X is yours but royalties must be paid to the university.


Added edit - for those saying public company information - that you created, it's public for the shareholders and the market, that still doesn't give you the right to divulge to some competitor. Any information on say that financial statement you have could have breakdown on items NOT contained in the public financial statement. No company gives break down to the exact penny, unless requested. You always get the big numbers, "misc expenses".

However, if Company A is a listed Company and you are pulling the financial statements from a public filing to show Company B, then it should be OK... but who the hell would ask for financial statements like that.

Find out where and if the financial statements were ever published somewhere. Then just send that. Like an annual report, for example.

If you're thinking of going into your hard drive and emailing documents from your computer, that would be quite stupid.

All in all, such a request makes no sense. A potential employer should take you on your word that you are capable of producing financial statements. If you can't convince them of that, you've got much bigger problems to figure out.

work done for student clubs indirectly help in getting a job, if u didn't sign a privacy agreement, u r good.

the process and idea is your, so yes u can disclose, ( i believe its a normal interview question :"did you develop a process or change that helped the company save money .. something along that line)
however if you created documentation for that company, that still is the property of that company..
