really depends on what state and their by-laws.

why do you think tommy chong went to jail for? the dude knew what he was doing and which state was illegal or not and all he was selling was bongs..... and it was a big conspiracy by the D.E.A and how they set his ass up and fucked him over. someone should check out his book biography or something and you'll get teh whole story
