The officer argued in B.C. Supreme Court in March that a motor vehicles adjudicator didn't properly consider his statement that he left the scene of the collision, had two shots of vodka and then returned to the scene.

this is the funniest thing i've read all day, and i read FC today AND cartoons in the newspaper. AND, the cartoons were actually funny!

This sounds like that one CSI Miami episode.

Since you went home, had a couple of shots, your BAC goes up and they can't tell if that is the alcohol consumed before or after the collision.

the more obvious thing to do is to keep a can of beer in the car (unopened - because that would be illegal) and then if/when you get into an accident, crack the beer open.

i think this sets some bad precedent for people to do the same... especially if they know they're the type to deliberately choosing to drive drunk...

my dads best friend was in the rcmp and he used to say that all the time, except he said keep it in the trunk

i'd say if you are a cop you'd know how to catch and avoid conviction, and since everyone is out there to save their own ass when shit hits the fan. well, you can see where i stand.

[3] The petitioner states that in answer to the allegations made before the adjudicator, his answer is that he had a blood alcohol level which exceeded 80 milligrams of alcohol in his blood “at the time of driving” was that he had a “last drink.” In short, says Mr. King ”the alcohol was in his stomach not his blood at the time of driving (and was subsequently absorbed prior to the sample being taken). Mr. King submits that the adjudicator failed to comprehend or recognize the “last drink” defence.

Basically, after reading some stuff online if i crashed into someone after drinking the case would be open and shut that I was intoxicated which led to the accident's occurrence. However, if I have a drink AFTER the accident, your BAC test would be null and void since it would A) show alcohol literally in my mouth, and it would be open to debate whether I had in fact drank prior to the accident and hence was intoxicated enough to cause the accident.

So I guess all drunk drivers getting pulled over can now say to the RCMP,

" Well ....the RCMP was not charged for drunk driving why should I get fined and arrested".

There's so much talk about this over the news already.....*sigh*

I don't believe you can keep just a can unless it's those big cans that they sell individually at liqour stores. If you have a 6 pack in the car with one gone but the other 5 are unopened it's still considered "opened" I think. I could be wrong here but at the very least that's what an officer told my friend haha.
