shouldnt it be the dealership that should be liable? . i thik mechanics are protected from this kinda stuff in their work legal documents. most that'll prolly happen to him is that he'll get fired.

I think the owner holds dealership responsible and dealership is supposed to hold person who crashed into the car responsible. Good thing the woman went to the news for this. Its enough bad publicity that they are caught doing stupid shit like this, at least they agreed to work something out for the owner (last chance to polish reputation on tv).

The payout of the insurance company is a lot more than the current value of the E350 in USA actually. My friend says Mercedes HERE would make you sign the same contract which also mentions an overnight test drive and that's exactly what happened. Legally the dealership is in the clear....
She's only hurtin' coz she went to buy a car that she couldn't really afford...She was paid enough to purchase another same-year same-condition E350 today which is very fair IMO.
Moral of the story is: you only buy cars cash or you lease it, financing it gives you this kind of headache. :blush:

Overnight test drives are very common now with high end vehicles to confirm faults/repairs, as stated in the repair orders the customers have to sign before handing over their keys. As far as I can tell from the video the dealership's story has not been proven to be incorrect, so if anything she should be dealing with her insurance company about the assessed value of her car and think twice next time about purchasing a car she can't comfortably afford. Yes it's a shitty situation but ultimately I don't see how the dealership should be liable for a motor vehicle accident where their mechanic was not at fault.

All local dealerships like MCL let customers know when the service adviser is taking the car for "extended test drive". Oh at least locally we have ICBC as one insurer.
As for the owner.. speaking of over extended one self financially for vain reasons and crying when things don't go her way. Upside down loan!? I guess prestige do trumps financial sense in the US. I guess she has have been living under a rock or have been sleeping through the financial crisis.
She should have done some research.. previous gen E class are unreliable.

So let me get this straight, this woman bought a used E350 for about 8k over book value? I know book values are usually below what a car would sell for but damn 20+% under? Either she was a sucker who was stretching out on a limb to look baller and paid insane amounts of interest or just way too dumb and bought a way overpriced car. She is LUCKY that the dealership is trying to help make up the diff and sell her a new car AT COST.
E350 owner looking all pimp and such but don't even have $7+k in the bank, poser much?

The dealerships Lawyer probably looked at their contract language (where it didnt indicate overnight test driving, etc) and the fact the News was knocking on their door and the owner "look dumbass do something before you lose more of your rep and get sued both of which=$$$"

The only reason she is a poser is because she bought a E350 to look rich and successful and ended up fessing that she can't even come out with 7k to pay for it (living beyond your means). If it was a corolla or accord or something less flashy no one would say anything.

Yes, but it being the US, you can probably come to the conclusion that the person who hit them either was under insured or had no insurance at all.
I can somewhat sympathize with her as her car got wrecked and it wasn't even her own doing. I guess from a legal perspective the dealership is in the clear, but morally it doesn't seem right to leave her hanging like that. In the end, I'm glad the dealership came through to make things right. They didn't explain specifically what they'd do other than "help her out" and sell her a Mercedes at cost but I highly doubt she'll ever be dealing with them again after this.

I used to work at Volvo and MCL and both of those places took cars over night.
I'm not sure if they contact the owner or not though.
She should buy the car at cost and take it elsewhere for service.

There isn't that much markup. Say you spend 100k on the car and you pay about 17k in taxes. Nobody is paying you retail so you wouldn't break even.
You'd be losing money.

i work at a dealership and there will be sometimes a tech taking a car overnight for test drives, with customer permission of course. i have a card saying that i am insured under ICBC for Universal Compulsory Automobile Insurance while driving customer vehicles.
