Montreal businessman, Adam Guerbuez was slapped with a CA$1 billion dollar fine for his spam artist escapades back in the spring of 2008. The controversial online marketer posted over 4 million spam messages during that time period, posing as a friend to post advertisements on users’ walls about marijuana, erectile dysfunction pills and penis enlargement pills(the hardcore trio). Originally he was fined 873 million dollars for this offense but via the November 2008 exchange rate, it works out to over CA $1 billion in damages caused.
Quebec Superior Court Justice, Lucie Fournier stated that this kind of spam spree is something never before seen by Facebook “Facebook had never been targeted by as much spam and the method used was particularly efficient given that the spam appeared to be coming from users' friends” Facebook went to the Quebec Superior Court and asked that they uphold the U.S verdict, which they did last week. Fournier on Tuesday said that Guerbuez could no longer have access to a Facebook account or any contact with the social media site.
Guerbuez is a polarizing figure who has glorified his standing in this online security matter, dubbing himself the “873 Million dollar man”. He called the judgment “ridiculous” on his online blog earlier today, addressing comments on the issue. In a June interview with www.emailsecuritymatters.com, he showed his bodacious side, thanking Facebook for using an “outrageous” lawsuit to help him gain popularity in headlines worldwide, saying all the free publicity has led to more promotional calls. Sarcastically he said “Facebook has repeatedly made public statements that I am BANNED for LIFE from using Facebook! Am I supposed to cry now? How will I live without Facebook?
Some questions remain as to if he can be forced of pay such a heavy fine after filing for bankruptcy. He told The Canadian Press that he doesn’t have to pay the damages given his current financial standing "I officially declared bankruptcy and it was filed and put into effect over two months ago. This judgment was already deposed as part of the bankruptcy.”
Guerbuez’s lawyer, Eric Potvin says the fine is excessive and impossible to pay off. On the contrary, Potvin thinks this is a positive marketing ploy for his client. "I believe that this whole situation is definitely a plus for him as far as the marketing goes.”
