Tenants complaining about private property and blaming us?

so, we've had this lady living with her boyfriend in our basement ever since mid summer ish. she and her boyfriend's a smoker, so they took the "batteries"(my parents say it's powered by the house wires, not batteries) out of the smoke alarm for the basement when they moved in. just today, the smoke alarm went off as her boyfriend was making toast. the lady came upstairs and asked if we ever went inside to setup the alarm while no one was home. my parents didn't do anything and neither did anyone in our household including me. she says it's only her and my parents that have the keys to the basement so i guess she's trying to blame us? i know her boyfriend has one as well so i was thinking maybe it was a setup?:S anyways, she asked for a copy of the signed tenant agreement and she also got a lawyer to call us tomorrow. i don't know if it's setup or she's bullshitting or whatever, but she's just gonna be wasting time and money on this. is there anyway to make it not such a big deal, anyway we could back our side up, any tips on handling this, etc?

also, their basement has been broken into a few days after they first moved in and i find it funny that they didn't make that such a big deal.. all they did was ask us what happened, they had no lawyer and didn't make it a big deal. they're also pot heads as well. we've started to grow suspicious of them lately because my dad's seen them smoking weed with the tenants on the other side and we always have to ask them to do it else where. my dad doesn't mind that they smoke weed, just not near the house where there's a family upstairs. they even offered me to blaze with them too. i don't do that shit lol. not to be stereotypical, but the boyfriend seemed to be like a gangster or something. shaved head, tattoos all over his body and all over his head. lots of his buddies come and go as well. they also asked us if they were allowed to change the carpeting to tiles in one of the rooms and we got suspicious and thought maybe it was for a grow-op. they're moving out soon anyways, so i don't think that'll happen.

I would sue her for disabling safety equipment and risking the lives of those living upstairs. I would force them to keep it wired. and not smoke inside.

who the hell lets tenants smoke inside, let alone smoke weed on their property. Good luck finding another landlord that doesnt mind you smoking in your suite.

As far as the smoke detector its likely that its hard wired with a battery backup. And in any case the lawyer isnt going to do shit, id be surprised if these idiots even have a lawyer let alone a lawyer stupid enough to take this case. its not like its going to go to court, even if it does defend yourself, they dont have any evidence.

For once I (mostly ) agree with you. Wouldn't necessarily sue them, but state that disabling safety equipment likely contravenes whatever tenant protection shit is out there helps goes toward nulling their rental agreement.

thanks, i also forgot to mention that another reason she disconnected the alarm was because it sounds whenever the steam from the shower gets to it.. that seems more of an excuse though

If steam affecting the smoke alarm is her only excuse, tell her that you'll gladly move it away from the bathroom and into a more ventilated area.

She shouldn't be able to complain then.

Taking the battery out of the smoke alarm won't stop it from going off unless there's a black out. The battery is just for back up...

lol on your lease agreement did you have something like no smoking inside and no illegal stuff is allow? If you do then you have every right to kick them out of the house.

My parents use to have a teante in the basement that msokes but he always do it outside.

Sounds like your tenate isn't very nice either. If the contract is up soon I would say just kick them out afterwards(at least let them know you don't want to contiune to rent them).

If she took the batteries out of the fire alarm with the intent of disabling it her whole rental agreement is null and void. As is your home insurance.

I would go to the BC Tenancy Act page and download the eviction forms and serve them to her.

Yeah I personally would have not let smokers rent out my place. And I mean, even if they seemed like good people, I would ask if they would smoke outside.

You haven't evicted them?

If they get a lawyer, and your renting out a illegal basement suite with smoke alarms that aren't hard wired in place, they might have a case. If the suite's legal I'm sure your fine.

thanks everyone, they're leaving by the end of this month. and no lawyer called us at least they didn't do as much damage as my aunts place. her basement had huuuge holes in the wall, fridge was broken, oven glass was smashed, we even had to pay movers to get their shit out and we helped them rent a car to gtfo. >_____________________>

Buy a house/apartment/townhouse, take out a mortgage if needed, rent it out (which covers the mortgage if you did take one out), sell it when the market value rises, Profit.
