Judge bans man with low IQ from having sex

A man with a low IQ has been banned from having sexual intercourse by a High Court judge who admitted the case raised questions about "civil liberties and personal autonomy".

The 41 year-old had been in a relationship with a man with whom he lived and told officials "it would make me feel happy" for it to continue.

But his local council, which provides his accommodation, decided his "vigorous sex drive" was inappropriate and that with an IQ of 48 and a "moderate" learning disability, he did not understand what he was doing. It started legal proceedings to restrict the relationship.

A psychiatrist involved in the case tried to prevent the man being given sex education, on the grounds that it would leave him "confused".

Mr Justice Mostyn said the case was "legally, intellectually and morally" complex as sex is "one of the most basic human functions" and the court must "tread especially carefully" when the state tries to curtail it.

But he agreed that the man, known only as Alan, should not be allowed to have intercourse with anyone on the grounds that he did not have the mental capacity to understand the health risks associated with his actions.

Under the judge's order, the man is now subject to "close supervision" by the local authority to ensure he does not break the highly unusual order. The judge concluded: "Alan does not have the capacity to consent to and engage in sexual relations.

"In such circumstances it is agreed that the present regime for Alan's supervision and for the prevention of future sexual activity is in his best interests."

It is the latest controversial case to come before Britain's Court of Protection. Under the Mental Capacity Act 2005, its judges have the power to make life-or-death decisions for people deemed to lack the intelligence to make them for themselves - such as ordering that they undergo surgery, have forced abortions, have life-support switched off or be forced to use contraception.

In the latest case, the man known as Alan was described as being physically able but "seriously challenged in all aspects of his mental functionality". He lived in a home provided by the council, where he developed a sexual relationship with a man called Kieron by the court. Alan was also accused of making lewd gestures at children in a dentists' surgery and on a bus, although no police action was taken.

The town hall began court proceedings in 2009 to restrict contact with Kieron on the grounds that he lacked mental capacity, and an interim order was made.

"Since then Alan has been subjected to close supervision to prevent any further sexual activity on his part," said the judge.

I hate the UK. That whole concept that the gov't can live your life better than you. It's scary!

First, I think this definitely has something to do with it being homo. Scary right there.

Second, where is the cut off to being allowed to get laid? IQ of 45, no ass for you, but 50 is cool, go get it on?

Third, he's a ward of the state, so that makes it seem like they have a right to make decisions for him.

You couldn't pay me enough to move there. Visit for a week, sure. Never would I knowingly move to the UK. Cameras everywhere, tax and spend policies that will eventually go bust.

Shit...I could go on forever. Bad, bad place.

I'll guarantee you people would care more if he wasn't wanting to do men. That's a problem for me, as I'm a firm believer in the gov't not belonging in bedrooms. Period.

If he was scoring with a woman, people would be congratulating him.

As far as him being on social assistance, what does it really matter?

The headline sounds scarily like eugenics, bringing science back a few hundred years or so. But really it makes sense, it's more about the guy not being able to take proper care of himself.

EDIT: Wow, not as long ago as I thought... Read the whole Wiki (http://en.wikipedia.org/wiki/Eugenics) on it, it's quite fascinating (and scary)

I believe in the early 20th century the US forced sterilization of some lower class people, however, I also believe that the gov't didn't follow through with this completely since its easier to control "dumb" people.

Why would basic sex ed confuse him being that its a instinctive urge? Because basic sex ed is based on straight coupling. One would assume this half wit has never had a chance to copulate with a woman. A difference he has yet to distinguish so he satisfies those urges with a man.
By these assessments I think it would be safe to assume the gov is basing this judgment on the fact its a gay relationship if he was screwing a woman he'd be left alone and or be given sex ed in an attempt to understand the risks.

In Alberta, the Sexual Sterilization Act was enacted in 1928, focusing the movement on the sterilization of mentally deficient individuals, as determined by the Alberta Eugenics Board.

Individuals were assessed using IQ tests like the Stanford-Binet. This posed a problem to new immigrants arriving in Canada, as many had not mastered the English language, and often their scores denoted them as having impaired intellectual functioning. As a result, many of those sterilized under the Sexual Sterilization Act were immigrants who were unfairly categorized.[102] The province of British Columbia enacted its own Sexual Sterilization Act in 1933. As in Alberta, the British Columbia Eugenics Board could recommend the sterilization of those it considered to be suffering from "mental disease or mental deficiency."

Although the eugenics excesses of Nazi Germany diminished the popularity of the eugenics movement, the Sexual Sterilization Acts of Alberta and British Columbia were not repealed until 1972

this is not something I wrote. My friend wrote a song about a kid, based eugenics. This is one of his blog entries about the songs inspiration:

So, I guess to start out I’m a bit of an information addict. I spend a lot of time going through science journals and magazines. Curiosity gets me every time.

One evening I came across an article on Charles Darwin and in the latter portion it mentioned eugenics. Something that I knew a little bit about but only as far as the Nazi genealogy and breeding experiments performed during WWII. I decided to dig a bit further online to see what I could learn. I was astounded by what I found. I had no idea to what extent eugenics spread through the rest of the world.

Francis Galton, second cousin to Charles Darwin, coined the term "Eugenics", meaning "the science which deals with all influences that improve inborn qualities", or more directly in Latin “well born.”

Eugene.... is a reference to the eugenics programs running from the mid 1800's through to the early 1970's in many civilized countries around the world including Canada and the United States. Essentially some felt that they could breed out the “less desirable” traits of humanity by picking and choosing who should be allowed to have children and then sterilizing the “unwanted” like the mentally ill, the chronically sick and the criminally inclined, imposing massive and terrible human rights violations upon millions. The U.S. had poster “families” of the undesirables called the Jukes representing inherited criminality, The Kalikaks for the mentally ill or those suffering from “retardation” (homosexuality also fell under mental illness), The Zeros, The Nams, The Happy Hickories, The family of Sam Sixty(his I.Q.), The Dolittles and so on. Most of which are pseudonyms. Only a few are based on real families.


Richard Dugdale published a family tree of the Jukes identifying 709 people descended over five generations from one woman, Ada Juke. Most could have at one point or another been found in asylums, brothels, prisons and poor houses at what was considered to be an enormous expense to the state, all said to be due to the fertility of one individual. This information was used as a basis for the argument that “degenerates” bred “degenerates.” Dugdales work amongst many others (many of whom are not doctors or accredited scientists) spurred statutes in 29 states permitting sterilization of the insane and feeble-minded, of which 12 also covered sterilization of criminals.


Over a 61 year period in the U.S. more than 64 000 sterilizations were performed approximately half on the basis of insanity, a sixth for feeblemindedness then criminality and even some for epilepsy. Eugenics reached its peak popularity by the mid 1930’s going into sharp decline after WWII. By the 1960’s sterilizations became far less common though vasectomy was still sometimes used as a condition of parole. The last publicly funded eugenics program was finally shutdown in 1972 in Sweden.


I created the fictional character Eugenix Juke as a reminder of the incredibly sad and horrible things man has done for the sake of “the betterment of the species.”
Genetic engineering and manipulation programs hold many similar qualities to the idealistic beginnings of eugenics. Mankind now has the ability to steer evolution at a level that before the mapping of the human genome was completely unheard of. It is now possible to detect many diseases and vaccinate against others even to change eye color and skin tone all within the first months of conception. I bring this up because of the knifes edge that this type of research sits.


Now to be clear I am in no way saying that the research and developments in the field of genetics should not be pursued. I just want pose the question at what point do we find ourselves outside the ethical application of such tools? The purpose behind “Eugene” is to promote conversation and awareness and hopefully perk up some of your own curiosity on these subjects.
