shtone

sup all....
so i am trying to find a way to get my tenant to move out... he doesnt listen when we say dont smoke in the house...
so far i only thought of one way, get stink bombs, tie a string to it and blow it up in his room under the door, obviously while he is not home...
any other ideas?
BTW does anyone know where to get these stink bombs? i remember seeing some in a dollar store long time ago but not sure if its still there...

He's your tenant, which means you are the landlord. Give him a notice of eviction, as he hasn't complied with his rental terms of agreement.
....or, you have a spare set of keys that you can use to move everything of his outside onto your front lawn and change the locks. :p
...and why is this in VAC?

the thing is we are not realy renting out legaly.... i am not the lanlord, my mom is and we think he scammed out my mom(to long of story)... would we still be able to evict him or no?
Nlkko
03-17-2011, 04:44 PM
Yea immediately serve him a notice of eviction if the agreement said no smoking with his signature. He'd have to move out after 30 days I believe. If he's not home or avoiding, stick it to his door--it'd be deemed served after 3 days.
You can only evict him immediately if the situation is extremely serious--which it is not. Even then you'd have to give him 5 days? And he can dispute it which is troublesome. Just take it for the next 30days.
You cannot kick him or his stuffs out yourself though or even changing the locks, that's illegal and you'd be in big trouble.
falcon
03-17-2011, 04:44 PM
Yeah, just tell him he's out of there. And bill him for the carpet cleaning.
Is this a legal suite with a contract? If so, is there a no smoking clause? If not, or it's an illegal suite you're out of luck.

And I would suggest giving him notice that you will be entering the property and before you give him his notice, take photos with date stamps of the whole place. Best to use a newspaper with the date just to be sure youre time stamp won't be questioned.

I don't think you're left with much LEGAL option. You can't throw him out. The suite is illegally rented but that's the problem of the landlord and municipal--they can get whipped pretty bad if they complain to authority.
The tenant in the illegal suite, ironically, is covered by every rights in the tenancy act because the agreement between you and him itself isn't illegal.
I hate fuckheads like those. They're one of the reason why it's sooo hard to find a decent place that is priced reasonably. They should all be fucking shot.

03-17-2011, 07:00 PM
Don't serve him a notice just toss him out. If he won't move tell him you are going to call the cops for trespassing. You have no signed contract so he has know right to be there and has no proof he is renting from you. Cops will come and arrest him if he does not move.
remember: DO NOT SERVE HIM A NOTICE. It will only provide him documented proof that he was renting from you.

Wrong, tenants of illegal units have the same rights as tenants Of legally declared units. Be a man and serve him notice. If he doesn't vacate, then you can throw him out.

If you fuck with him, watch what he does to your basement...
ready to mix concrete and toilets/drain pipes dont mix very well.
So no dont put a stink bomb in his suite...give him a notice of eviction, he doesn't have to know its an illegal suite, just give him the notice and be done with it
http://www.rto.gov.bc.ca/content/rightsResponsibilities/ending.aspx#195
It is against the law for a landlord to (1) physically evict a tenant without a Writ of Possession, or (2) change the locks without a
Dispute Resolution Officer’s order to do so, or (3) seize a tenant’s personal property without a court order. its also illegal to enter his suite without his permission UNLESS its an emergency such as the hot water tank is leaking or something serious of that nature...If you want to enter you have to give him a written notice at least 24 hours prior to entry
O and you can get stink bombs at a paintball shop im sure....don't recommend it thought :)

You can't throw him out yourself. You have hire a bailiff. But I'm afraid for the OP that there'd be trouble if he dispute it (good news is that most would just leave) and the municipal find out you're renting it out illegally, you would have to pay fines (don't know how much though).
If you decide to serve the notice, do it right away as this process take a long time.

change the locks. he has to leave the house to work does he not?
He cant do anything if you change the locks, he can call the cops and you can deny everything, you have no documented proof that he lives in the basement, thus he cant get you in trouble.

I read before I posted, your managing the tenancy for you mother effectively making you the landlord, except your mother will suffer the fines.
Want to know whats hilarious about this situation, genius?
Even though you/your mother have no rights, your tenant still does and can seek monetary damages for harassment and damages.

Serve the notice, just say you are doing major reno's (replacing floors, kitchen etc) downstairs then selling the house. Also ask him to let you in to do some measurements for the floors or kitchen cabinets... sounds believable.
dont fuck this one up. the fines are $50-200 A DAY.

Use a Milk Chicken Bomb
a truely vile surprise. heres how it works. first, take a glass jar (must be glass). make sure its got big enough of an opening to accept a leg or breast of chicken. next, get uncooked chicken parts and milk. it helps if the milk has alredy gone bad. combine milk and chicken in the glass jar until you cant fit anymore and its about to overflow. next, tightly secure the top onto the glass jar. now, discretely place the bomb in the heating ducts of a home or apartment. this is most effective after getting evicted or you catch your gurlfriend cheating on you. the next step is to simply wait. it may take time, so be patient. what happens is after repeated exposure to heat and pressure, the glass will eventually break or the top will pop off. if you can only find a rather thick jar you may want to poke a small hole into the top to ensure the smell gets released. after this happens, the most vile stench is released throughout the home, creating a constant unbareable smell that only gets worse every time the heat goes on. milk chicken bombs, when made and dispensed properly, have been known to make a home unliveable.

So you have a party some dudes to drunk so sleeps on the couch and now won't leave what do you do. Give him a 14 day notice for not paying rent?
If you want to kick out a legal tenant you can't just kick him out after giving him a notice. If he refuses to leave you have to go threw arbitration that can take months and still you can't just throw his stuff out.
If the tenant has no proof that he is a tenant or that he is paying rent he's just a guest that won't leave.

It's not really considered an 'illegal suite' - it's not a criminal offence. It's simply an 'unauthorized suite'.
I recently had to deal with the same issue - and I had a cop renting my suite! It doesn't matter who rents, how it's rented, or how long they've rented... You must abide by the tennancy agreement. If the tennant has violated the terms of your contract (verbal or written) and you have followed the necessary protocol, you can give them notice to leave at any time.
You can also call the tennancy board and pose the situation to them further - they don't care whether the suite is authorized or un-authorized (that's a city bylaw) and they can direct you how to proceed.

I've recently had to go through a dispute resolution with our tenant.. and when it comes to Verbal agreements, Landlords almost always lose. That's the sad part about Tenancy board, they tend to side with the tenants.
So hopefully you have some written contract, or else you and your mom may be in a bad position.

if the OP doesn't have common sense, why help him...
and for all those telling him to go inside while hes out, just asking for trouble... he can sue for enter without permission.. 24hr notice is need to enter the suite without him present... even if you were to change the locks, you are still enter the suite..
Here is a tip:
Did you write up a contract stating the rules while he is renting? if you did, then just give him a Notice Of Eviction for breach of contract.. if he still doesnt, pay money and get a bailiff
Try this (http://www.activebailiff.com/)
