Help: Witness Needed on (Main and Marine Drive) April 21st 11:30 PM

Hi everyone, I got into a huge accident on marine drive and main

I'm driving the rsx.

if anyone witness the accident, please contact me as soon as possible

don't know if the chevron there would have captured any footage, maybe ask them as well?

I passed you right after the accident happen, it was with a van correct? Unfortunately I didn't see what happen.

I was turning left on marine drive on to main, when the yellow light pretty much turned red. Cars infront of him stopped, so i decided to turn. while my turn is almost done, this van came really fast and he gunned it and hit me so hard that I did a 180 degree turn.

wow, ouch man. like somebody else said, maybe chevron has footage?

good luck, hope you're okay. sounds like a pretty bad accident
couldn't get any witnesses at the scene?

ouch. i hate idiots who run late yellows and reds. Hope you are OK. Be sure to see a Dr. When you call ICBC, they will ask if you are medically OK. Tell them you will wait for a Dr to submit a medical report. So don't go telling them anything premature.

However i heard ICBC gives right of way to the guy going straight even if he is gunning a light, can anyone else confirm this?

Chevron at Main & Marine only have cameras pointing at their Pumps + inside store.

unless the van ran a stale red, in ICBCs eyes unless there is some strong evidence, left turners are almost always at fault.

hey OP did the van do a lane change to dodge the guy infront of him whom stopped THEN hit you?

I went through a yellow and hit a 18 y/o kid in a tiny geo a while back. I think it turned out he had a "witness" saying it was red, anyways, I think he got Scrouge McDuck money out of it and I was only travelling at like ~50km/hr, he appeared totally fine.

Go see your doctor asap and don't settle immediately, little injuries come out after a few days

Regarding to ICBC decision on accidents like this:

If the van hit the rear half of OP's car, it could be the van's fault. (I believe it is because the Van should have enough time to brake to avoid the accident; or if there are solid proofs that the Van was speeding through the intersection)

However, if it was a direct T-bone or the impact was on the front-end (ie.fender) of the RSX, it would be OP's fault.

Its up the the left turner to make sure the intersection is clear and safe to proceed. Im sure there will be exceptions to this. My accident had 8 witnesses, 5 of which pointed their finger and blamed me. I was found not at fault because of the one witness. It came down to the witness that was traveling behind me, because he had the same direction of travel of me. If he ran a red, I could see it being 50/50. If he ran a stale red and you have a witness then you should be ok. Sorry to hear about your accident, hope everyone is ok and things work out in your favor.

you sure? Icbc doesn't know how fast the op tried to tub. He could have floored it to try and make the gap, and because he was travelling fast the oncoming van would have hit his rear....

let me clear things up a bit:
1.I was going slow enough that the van can see me clearly from far away
2.he showed no signs of breaking when he hit me, matter of fact accelerating
3.i know for a fact that he ran a red, because when my turn almost finished, it's green on main already. and all of sudden i got hit badly.
4. also when i about to turn on yellow, it just turned red when i began to turn
4.someone called the ambulance for us, is there a way to track that phone number? possible witness?

right now i just need witness to help me out, because i have no collison covered on that car. pretty much all the money down the drain. and insurance rate to the roof...

ps. hes and california driver, driving a company car.

please help, thanks.

You saw no signs of him braking/slowing down and you still continued with the turn?
also i hope you copied down his insurance company papers, just his D/L and plates is not enough for ICBC. Say he leaves back to the US, ICBC tracks him down/contacts through his insurance company.

put up some signs around the area see if you get any repsonse.

You must be one of those tards that take the left turn in an intersection at 10km/h. The light turned green and you were still in the intersection?

Oh, and if you were in the right, you'd have people stopping by and giving you their number as witnesses.

Ya dude sorry to say but I dont think this is sounding very good for you. One good thing you do have going for you is that ICBC will actually fight your case for you. If they can get the other guy at fault then they wont have to pay out a claim, the other insurance company will. Not the usual ICBC vs ICBC insurance claim. Also if i were you I would edit that last post of yours, matrixfwd has got a point and you never know who is reading this thread. Did the police show up on scene?? Ambulance, fire truck too??

Sorry bro, the person turning 95% of the time loses, and this case is no exception. Turning driver has to make sure the intersection is clear of all dangers before proceeding. That is exactly what ICBC will tell you.

thanks to all,

he was going slow enough that i thought he would stop by the line because others stopped before him. but he accelerated all of sudden and hit me, when i mean no signs of stopping is when he hit me, he did not even brake. i think either his playing with his phone or something who knows

Tell them how it was and hope for the best. If you could get one of those other drivers that were infront of him that did stop to witness I have a feeling you would be in the clear as from the sounds of what you are telling us, he truely is at fault here. Some people do hit the brakes for a split second then decide they wont be able to stop, Ive seen that happen. Lots of repeat travellers on that road Im sure going to and from work everyday, put up signs Im pulling for you. And remember, this isnt the typical ICBC vs ICBC case, that is going to work out big time in your favor

One thing I don't understand is, if people stopped in front of him, how did he approach the intersection?

Is he driving on the right lane and people on the left stopped? If that's the case, then he would be in your blindspot and you would have to make your turn with extreme caution.

If you saw him (and if that's what you told ICBC) and still made the turn, you're most likely going to be at fault unless you have witnesses pointing out that he ran a red, which in his case, still can be fought in court unless the witness you have is the one crossing the road on the red light.

And yes, left turners are always at fault.
